Overtime Sports website class action overview:

Overtime Sports runs a website that is not accessible to blind and visually impaired people using a screen reader, in violation of the law, a new class action lawsuit alleges. 

Plaintiff Linda Slade filed the class action lawsuit against Overtime Sports Inc. on Sept. 14 in a New York federal court, alleging violations of the Americans with Disabilities Act (ADA), as well as New York human rights and civil rights laws. 

According to the lawsuit, the media company has violated the civil rights of visually impaired people by failing to run a website that is accessible to them.

The media company produces more than 40 series that fans can watch on YouTube, Snapchat and other platforms, Slade says. From its website, Overtime.tv, consumers can navigate to a wide range of content, buy merchandise and browse job openings with the company.

However, none of these opportunities are available to blind and visually impaired people, because of the multiple access barriers on the site, Slade alleges. 

Overtime Sports website contains ‘thousands’ of barrier, lawsuit alleges

According to the lawsuit, Overtime.tv contains thousands of access barriers that make it “difficult if not impossible” for blind and visually impaired customers to use the website.

“In fact, the access barriers make it impossible for blind and visually impaired users to even complete a transaction on the website,” Slade states.

The barriers include no vocal cues being available, access with only a mouse and not a keyboard and the lack of navigation links and an image map, the lawsuit states.

Slade is looking to represent any legally blind person who tried to access the website and could not, plus a New York subclass. 

She is seeking a permanent injunction that requires the company to take necessary steps to make the website ADA-compliant. She’s also seeking certification of the class, damages, fees, costs and a jury trial.

A number of class action lawsuits have recently been filed by blind and visually impaired individuals alleging companies failed to make their websites in such a way as to grant full accessibility, including allegations that Hy-Vee’s website is not accessible to legally blind people who use a screen reader.
