AstraZeneca Pharmaceuticals is facing a recent Nexium CKD lawsuit filed by a woman alleging she suffered long term side effects due to taking the proton-pump inhibitor.
Plaintiff Daphine T. filed the Nexium CKD lawsuit in New Jersey federal court joining a growing multidistrict litigation (MDL) against the company. The lawsuit was filed on June 5, 2018, in the Eastern District of Tennessee, Winchester Division.
According to the Nexium CKD lawsuit, Daphine, a resident of Estill Springs, Tenn., says that she began taking Nexium in June 2003 through December 2016. However, she says that she was never properly warned of the kidney risks associated with Nexium. She says that she suffered and developed Chronic Kidney Disease (CKD) as a result of taking the medication.
The Nexium CKD lawsuit was filed on multiple counts including strict product liability, design defect, failure to warn, negligence, negligence per se, breach of express warranty, breach of implied warranty, negligent misrepresentation, fraud and fraudulent misrepresentation, fraudulent concealment, and violation of state consumer protection laws of the state of Tennessee and throughout the United States.
Overview: Nexium CKD
Nexium (esomeprazole) is a proton pump inhibitor (PPI) that works to lessen the amount of acid production produced by the stomach. It may be prescribed to treat conditions such as dyspepsia, or indigestion; peptic ulcer disease; gastroesophageal reflux disease (GERD); and Zollinger-Ellison syndrome. It may also be prescribed to treat esophagitis or inflammation that damages the esophagus.
Nexium may also be used by patients who take NSAIDs, or nonsteroidal anti-inflammatory drugs as Nexium helps prevent NSAIDs’ propensity to develop stomach ulcers. PPIs include Prevacid, Protonix, Prilosec, Aciphex, and Zegerid.
However, there have been a number of adverse side effects and complications linked to Nexium. In fact, hundreds of injury reports have been filed with the U.S. Food and Drug Administration (FDA). Common side effects of Nexium may include some of the following: diarrhea, nausea, vomiting, stomach pain, gas, constipation, headaches, drowsiness, dry mouth, rash, dizziness, and nervousness.
There are serious side effects, however, linked to Nexium. These adverse side effects are linked to a number of kidney injuries, and excessive risk of kidney injury was filed through FDA injury reports and submitted to AstraZeneca. These injuries range from chronic kidney disease, acute kidney injury, renal/kidney failure, and acute interstitial nephritis.
Although Nexium long- term side effects continue to affect and harm consumers taking the PPI medication, AstraZeneca is being accused of taking no action to warn consumers of the medical risks involved in taking Nexium. AstraZeneca continued to solely market Nexium as posing no risk of kidney injuries.
Additionally, the Journal of the American Society of Nephrology correlated adverse effects and complications to PPI medications. The study discovered that most patients prescribed PPIs developed some kind of adverse kidney complication. In fact, the study ascertained that patients taking PPIs had a 96 percent chance of developing kidney failure and an additional 28 percent chance of developing chronic kidney disease. The study compared patients taking alternate medications known as histamine H2 receptor blockers.
The Nexium CKD Lawsuit is Case No. 2:18-cv-10192-CCC-MF, in the U.S. District Court for the District of New Jersey, Newark Division.
In general, acid reflux medication lawsuits are filed individually by each plaintiff and are not class actions.
