A North Carolina woman has filed a Nexium lawsuit claiming that she developed chronic kidney disease from Nexium as well as other severe complications from taking the heartburn medication, Nexium.
Plaintiff Quillie A., a resident of North Carolina, first began taking Nexium in March 2002 and continued taking it until October 2010. She claims that she has suffered and continues to suffer from both chronic kidney disease from Nexium as well as chronic kidney failure.
She was diagnosed with chronic kidney failure and chronic kidney disease from Nexium on Oct. 8, 2008.
Quillie believes that her chronic kidney failure and chronic kidney disease from Nexium was as a direct result of taking Nexium and holds the drug manufacturers, AstraZeneca Pharmaceuticals, responsible.
Nexium is both an over-the-counter and prescription heartburn medication for the treatment of “peptic disorders which include gastroesophageal reflux disease (GERD), peptic ulcer disease, and nonsteroidal anti-inflammatory drug induced gastropathy,” the complaint reads.
According to this Nexium lawsuit, AstraZeneca “negligently represented to the medical and healthcare community, the Food and Drug Administration … the Plaintiff’s treating physicians, and the public in general, that Nexium had been tested and were found to be safe and/or effective for their indicated use in treating peptic disorders.”
The plaintiff believes that AstraZeneca concealed its knowledge of the defects of Nexium, including reports that there are serious kidney injuries associated with it. She believes that the drug manufacturer concealed this information from doctors, the plaintiff herself, hospitals, pharmacies, the FDA and the public in general.
Because of all of this, Quilllie alleges that she suffered from serious and dangerous side effects including chronic kidney disease from Nexium and chronic renal failure. Additionally, she claims she experienced “other severe and personal injuries which are permanent and lasting in nature, physical pain and mental anguish, including diminished enjoyment of life, as well as the need for lifelong medical treatment, monitoring and/or medications, and fear of developing any additional health consequences.”
She is seeking compensatory damages. The plaintiff is bringing forth claims of negligence, strict products liability, breach of express warranty, breach of implied warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit, violation of the New Jersey Consumer Fraud Act, and failure to warn.
Chronic Kidney Disease from Nexium
Nexium is a type of medication known as a proton pump inhibitor. It treats acid reflux by reducing the amount of acid in the stomach. However, it has been linked to chronic kidney disease from Nexium and chronic kidney failure.
One study in the Journal of the American Society of Nephrology found that people who take proton pump inhibitors like Nexium could be much more likely to develop kidney failure and chronic kidney disease. Over a five year span of time, fifteen percent of all users who took proton pump inhibitors developed chronic kidney disease.
Also, the longer the medications were taken, the more likely the patient was to develop chronic kidney disease.
This Nexium Lawsuit is case number 2:17-cv-09230-CCC-MF in the United States District Court of the District of New Jersey.
In general, acid reflux medication lawsuits are filed individually by each plaintiff and are not class actions.
