Nasal Ease class action settlementCustomers who purchased Nasal Ease are reporting they have received checks in the mail from a settlement over claims the nasal spray was falsely advertised as being able to temporarily relieve allergy symptoms.

Viewers are reporting on TopClassActions.com’s Facebook page that checks worth $15 were mailed to Class Members who participated in the Nasal Ease class action settlement.

Nasal Ease settlement

The Nasal Ease settlement resolves a class action lawsuit (Hoover v. Hi-Tech Pharmacal Co. Inc.) that alleges Nasal Ease was falsely advertised as having the ability to relieve allergy symptoms such as sneezing, sinus congestion and runny nose. The Nasal Ease class action lawsuit alleges the nasal spray’s ingredients have never been scientifically proven to relieve allergy symptoms and that Hi-Tech’s advertising statements were false and misleading.

Hi-Tech denies the allegations but agreed to settle the Nasal Ease class action lawsuit and provide compensation to consumers who purchased the products.

Class Members of the Nasal Ease class action settlement include consumers who purchased Nasal Ease nasal spray in the United States between April 1, 2010 and Feb. 25, 2014. Under the terms of the Nasal Ease settlement, Class Members were eligible to claim a full refund of their purchase with proof of purchase or up to $15 cash without a receipt. The deadline to file a claim was Feb. 25, 2014. [See our claim filing instructions here.]

The Nasal Ease False Advertising Class Action Lawsuit is Hoover v. Hi-Tech Pharmacal Co. Inc., Case No. EDCV 13-0097 JGB (OPx), in the U.S. District Court for the Central District of California.
