North Carolina plaintiff Rachel Hahn is suing Bayer Pharmaceuticals for the injuries she allegedly sustained from using their Yaz oral contraceptive pill. In her Yaz lawsuit, Hahn states that as a direct result of using the medication, she developed a pulmonary embolism and continues to suffer its consequences.
According to the Yaz lawsuit, Hahn was first prescribed Yaz in August 2008. She stayed with the birth control pill until December 2009, when she suffered a pulmonary embolism. Sometime before her diagnosis, she started experiencing painful side effects which prompted a medical exam. After she was diagnosed with the pulmonary embolism, she stopped taking the birth control pill.
Hahn’s Yaz lawsuit indicates that she is still suffering various side effects from her new condition. She states that if she had known about the possibility of developing pulmonary embolism, then she never would have taken the medication. There were reportedly no warnings or indications on the warning label, and the defendant company made no effort to notify her or her physician about the risks.
Overview of Yaz Complications
Yaz and Yasmin were approved by the U.S. Food & Drug Administration (FDA) in 2006 and 2001 respectively, and are both manufactured by Bayer. Yasmin is the older cousin of Yaz, and was the first Bayer product to use its famous fourth-generation progestin, drospirenone. Drospirenone is the primary hormone that composes Yaz, and is also the main ingredient of several other oral contraceptives manufactured by the pharmaceutical giant. Bayer is the only drug company in the United States that uses drospirenone.
Prior to the approval of drospirenone in 2001, there were several studies conducted that indicated that the hormone caused certain side effects that were not seen in previous generations of progestin. As of now, there is not much scientific available on drospirenone because it is so new to the market, which has made many medical experts concerned. According to past scientific studies, a confirmed side effect of drospirenone is that it causes the potassium levels in the blood to rise. This could lead to condition called hyperkalemia, which occurs when the blood in the body slows down, allowing for the possible development of blood clots. Many scientists feel that there is not yet enough data for this hormone to be used safely. Since its release, there have been hundreds of Yaz injury reports submitted to the FDA.
Due to the large number of Yaz injury lawsuits, the cases have been consolidated into multidistrict litigation.
The Yaz MDL is In Re: Yasmin and Yaz (Drospirenone) Marketing, Sales Practices, and Relevant Products Liability Litigation, MDL No. 2100, in the U.S. District Court for the Southern District of Illinois.
