Monsanto Company is facing a new non-Hodgkin lymphoma lawsuit from a grieving widow alleging their Roundup weedkiller caused her husband’s death. The non-Hodgkin lymphoma lawsuit alleges regular exposure to Roundup directly contributed to the development of cancer and ultimately caused the man’s death.
Arizona plaintiff Cindy W. is filing this non-Hodgkin lymphoma lawsuit on behalf of her late husband James W, alleging he developed this disease as a direct result of Roundup. Cindy alleges her husband’s death could have been prevented if he had known that the product’s main ingredient, glyphosate, was linked to cancer.
According to the non-Hodgkin lymphoma lawsuit, James was exposed to Roundup on a regular basis between 1995 through 2016. James used Roundup for personal uses on the couple’s property, in which he had followed all safety instructions and was not warned about possible carcinogenic effects.
James was diagnosed with non-Hodgkin lymphoma in February 2016 and died in December of the same year.
Overview of the non-Hodgkin Lymphoma Lawsuit
Cindy opted to file the non-Hodgkin lymphoma lawsuit, claiming the company either knew or should have known about the possible carcinogenic effects of their product. Cindy first learned of glyphosate’s alleged link to cancer after July 29, 2015, when the International Agency for Research on Cancer (IARC) first published its analysis of glyphosate.
The report consisted of several studies analyzing the risks of glyphosate, which concluded it was shown to cause cancer. These studies examined the use of glyphosate in different countries, and how the product impacted the health of farmers:
- Canada Study: This study was published by the American Association for Cancer Research in November 2001, and it showed that men exposed to glyphosate were at risk for non-Hodgkin lymphoma after less than 10 years after exposure.
- United States Study: This study, published in Occupational and Environmental Medicine, concluded glyphosate and certain other pesticides may be “potentially carcinogenic” and are associated with an increased risk for non-Hodgkin lymphoma.
- Sweden Study: This study was published in the International Journal of Cancer in October 2008, which found an increased risk of non-Hodgkin lymphoma diagnosis doubled after less than 10 years after exposure.
Along with glyphosate, the IARC had found four other pesticides were likely to cause cancer.
Researchers had begun to study the potential correlation between glyphosate and other pesticides and cancer after noticing numerous farmers had been diagnosed with non-Hodgkin lymphoma. In addition, the Environmental Protection Agency (EPA) had started to suspect a correlation between pesticides and cancer in the 1980s.
The Monsanto Company allegedly knew about this correlation for years but failed to notify consumers. The non-Hodgkin lymphoma lawsuit points out the earliest date of possible discover was in July 2015, which did not allow the plaintiffs a reasonable amount of time for prevention.
At all times relevant, Cindy states her husband had used Roundup for its intended purpose and did not deviate from product instructions. Cindy states her late husband would not have used Roundup if he had known about the product’s alleged carcinogenic effects.
Cindy is filing this non-Hodgkin lymphoma lawsuit, seeking multiple damages for negligence, failure to warn, and wrongful death.
This Non-Hodgkin Lymphoma Lawsuit is Case No. 4:17-cv-00602-DCB, in the U.S. District Court for the District of Arizona.
