McDonald’s lawsuit overview: 

  • Who: The Equal Employment Opportunity Commission filed a lawsuit on Title VII civil rights grounds against Oklahoma McDonald’s franchise Arch Fellow North LLC.
  • Why: An anonymous 17-year-old filed a complaint against a McDonald’s supervisor over alleged threats of rape and sexual harassment.
  • Where: The EEOC McDonald’s lawsuit was filed in federal court in Oklahoma.

The Equal Employment Opportunity Commission (EEOC) filed a lawsuit on Title VII civil grounds against McDonald’s after an anonymous 17-year-old accused a McDonald’s supervisor of threatening to rape her and sexual harassment.

The supervisor’s actions led the employee to resign from her position after she filed a complaint and action was not taken immediately, according to the McDonald’s lawsuit. The employee then said that she had to submit her resignation to the supervisor who had allegedly harassed her.

“Among other comments, (Mikel) Boone talked about D.B.E.’s body and petite figure; commented about her make-up while asking if she was a stripper; stated that he could ‘still make good use of her body’ if the fryers exploded; insinuated that D.B.E was getting him in trouble with his wife; and stated that he wanted to buy D.B.E. shoes that he picked out to watch her try on,” the McDonald’s lawsuit said.

The employee later had to go to a dark storage shed behind the restaurant to retrieve cups and asked her supervisor where to find them. The supervisor showed the employee where the cups were and, when they were leaving the shed, he allegedly said “You should be careful getting yourself alone with me, I might rape you,” according to the McDonald’s EEOC lawsuit. 

Supervisor admitted saying ‘rape’ but claims context was different than employees claims, lawsuit says

The supervisor, Boone, said that the incident went differently and what he really said was “this wouldn’t be a safe place because someone could get raped in here.” After the employee asked if he was a rapist, he said “Maybe I am,” according to his statements cited in the complaint.

Earlier this year, several McDonald’s franchisees agreed to an EEOC settlement of nearly $2 million to resolve claims they are liable for sexual harassment.
