- Where: The Jersey Mike’s lawsuit was filed in federal court in Atlanta.
Plaintiff Nikki Lett is suing the owner of three Jersey Mike’s restaurants in the Atlanta area for alleged sexual harassment and retaliation. The Jersey Mike’s lawsuit, filed April 5 in federal court in Atlanta, is aimed at franchisee Seven Out LLC, which operates the three Atlanta-area stores.
Lett has alleged that she was harassed by her manager at the downtown Atlanta store, first being called “sweety” and then being subjected to the manager talking about his sex life aloud, according to the Jersey Mike’s lawsuit.
The plaintiff alleges that she was then washing dishes and the manager came up behind her and thrust himself into her, commenting on how her body responded, according to the Jersey Mike’s Lawsuit.
Lett says that she asked the manager verbally to stop and then via text message the next day, asking him to respect her personal space, the Jersey Mike’s lawsuit said. But the plaintiff alleges that the manager then responded to the complaint by acting aggressive and rude around her.
The plaintiff then called the franchise owner, with a witness listening, and informed the owner of her complaints about the manager, the Jersey Mike’s lawsuit states. But the plaintiff felt that the franchise owner was attempting to minimize the complaint rather than act on it. So Lett said that she asked for the national Jersey Mike’s Human Resources phone number and the owner would not provide it.
The plaintiff then filed a complaint with the United States Equal Opportunity Employment Commission, which she provided to both the manager and franchise owner on Friday, April 8, 2022, according to the Jersey Mike’s complaint. The plaintiff then stated that she was not included on the April 10 schedule and was informed on April 18 that she was terminated from employment at Jersey Mike’s.

Add me
I was sexually harassed by a travel coach of jersey mikes. I told multiple people in the store, and they also witnessed it. I tried to play it off by always just walking away, because I was in fear of losing my job. But he would find his way next to me everywhere I went. It got to the point I didn’t want to go into the walk in cooler alone. He would always says nasty stuff to me. One of the employees told the man, what I said about him. And the next day he had me go to the Starbucks near the store (off the clock), and speak with him. He accused me of something I didn’t even do. While also saying “idk if you did I’m just saying”. I recorded the conversation on my cellphone. I then went to work, and was speaking to someone about it while also telling them about the new casino that opened up, and how it would be a good second job. he was eavesdropping from the other side of the store, and came over and confronted me about what I said. And told me I can’t discuss working another job. Or anything me and him talk about. Saying I was being inappropriate. I then got a email from him stating, I was not and will not be fired. And he made up a whole bunch of rules he wanted me to follow and took alot of my work hours away. He was punishing me. For speaking up to the girls in the store. I was fired 4 days after that Starbucks conversation. On 4/20/2023. Off the clock. I was actually on my way to work when my mother told me I was fired. And I called one of the higher ups I thought I was close to, to see if it was true. And she confirmed, & refused to tell me why. She said to call HR. I also recorded that phone call.
