A massive Essure lawsuit has been filed by dozens of women who claim they have suffered permanent Essure injuries as a result of using the permanent sterilization contraceptive device.
The women in the Essure lawsuit allege that their permanent Essure injuries were caused by Bayer and Conceptus, the previous company that manufactured Essure, improperly following FDA regulations.
The lawsuit alleges that Conceptus attempted to solve their debt problems and gain profits by their sale of the Essure birth control device.
It also alleges that Conceptus manipulated safety information, allowing it to become a viable company.
The women in the Essure lawsuit states that Conceptus and Bayer have always known that Essure birth control device is dangerous, yet they continue to spread false and misleading information to the public in an attempt to alter the perceptions of the safety risk of the device.
The claim goes on to state that the medical community is now starting to understand that Essure is dangerous and is not as effective as more traditional methods of permanent sterilization.
The lawsuit argues that women who were implanted with the Essure medical device are 10 times more likely to have a surgical re-operation than women who initially undergo a tubal ligation for sterilization.
Types of Permanent Essure Injuries
The lawsuit highlights general allegations as well as specific plaintiff allegations that detail the permanent Essure injuries personally experienced by each plaintiff in the lawsuit.
The general allegations include the following statement: “Conceptus and Bayer knew, and-or had reason to know, that Essure was defective, unreasonably dangerous and not safe because of the thousands of adverse events that both companies knew about.”
The lawsuit alleges that the plaintiffs would not have consented to have the Essure permanent birth control device implanted if they had known and been fully informed by the manufacturers “of the true increased risks, hazards, and serious dangers of Essure.”
The permanent Essure injuries highlighted by the scores of plaintiffs include:
- Severe pain and discomfort
- Heavy menstrual bleeding
- Chronic pelvic pain
- Chronic back pain
- Abdominal pain
- Abdominal bloating
- Pain during intercourse
- Excessive hair loss
- Dental problems
- Chronic fatigue
- Excessive weight gain
- Allergic reactions
- Autoimmune disorders
- Hysterectomy
- Loss of libido
- Migraines
- Organ perforation
- Coil migration
- Pregnancy
- Coil fracture or breakage
Claims Brought Forth in the Essure Lawsuit
Together, the women have brought forth 14 counts against Bayer and Conceptus including multiple counts of negligence, strict liability for failure to warn, manufacturing defect, multiple counts of fraud and fraudulent concealment, breaches of express and implied warranties, violation of consumer protection laws, violation of the Missouri Merchandising Practices Act, Missouri Products Liability Action and gross negligence/punitive damages.
The plaintiffs are seeking relief in terms of compensatory damages for pain and suffering, for permanent Essure injuries and cost of medical care, for economic and noneconomic damages, for specific damages, for punitive and exemplary damages, for pre- and post-judgment interest, for attorneys’ fees and costs and any additional relief as deemed proper by the court.
The Permanent Essure Injuries Lawsuit is Case No. 1622-cc10033 in the Circuit Court of the City of St. Louis, State of Missouri.
