A man filed a non-Hodgkin lymphoma lawsuit against the makers of the popular weed killer product Roundup, alleging his cancer development is a direct and proximate result of product use.
Plaintiff Maurice B. filed the non-Hodgkin lymphoma lawsuit in Florida federal court. The lawsuit was filed on Feb. 20, 2018 against the Monsanto Company.
According to the non-Hodgkin lymphoma lawsuit, Maurice, a resident of Orlando, Fla., says that he used Roundup from approximately 1984 to 2017. He was diagnosed with non-Hodgkin lymphoma on Feb. 10, 2014.
Monsanto Roundup Weed Killer
Accusations against the Monsanto Company include that glyphosate, the Roundup product’s main ingredient, is carcinogenic, causing the development of a variety of cancers including non-Hodgkin lymphoma.
Recent lawsuits against the company further allege that Monsanto had known of the cancer risk for decades, but falsely represented the safety of Roundup to the public.
In fact, the International Agency for Research on Cancer (IARC) issued a formal monograph on July 29, 2015 classifying glyphosate as a Group 2A carcinogen that is possibly carcinogenic to humans, according to the lawsuit. With these facts known, however, the plaintiff asserts that the company continues to falsely represent the product’s safety to consumers.
According to the non-Hodgkin lymphoma lawsuit, Monsanto first introduced Roundup as a “technological breakthrough,” touting the product as one that “could kill almost every weed without causing harm either to people or the environment.” This is partly why farms across the world have used Roundup as a weed killer product for almost 40 years.
The lawsuit asserts that the World Health Organization, however, has also said of the glyphosate ingredient that it is a probable cause of cancer. Unfortunately, persons that are most at risk include those that have workplace exposure to Roundup, such as landscapers, garden center workers, and nursery workers.
“Agricultural workers are, once again, victims of corporate agreed,” the non-Hodgkin lymphoma lawsuit reads.
Monsanto has long tried to prove the safety and efficacy of Roundup. To do this, “Monsanto has championed falsified data and has attacked legitimate studies that revealed Roundup’s dangers,” the non-Hodgkin lymphoma lawsuit alleges.
The lawsuit claims that Monsanto committed fraud by championing falsified data.
The lawsuit alleges that the laboratories the company hired that would test Roundup’s toxicity committed fraud. According to the lawsuit, the U.S. Food and Drug Administration (FDA) inspected the findings of Industrial Bio-Test Laboratories, the company Monsanto hired to preform toxicology studies.
Through the FDA’s inspection, the lawsuit alleges, the agency found “discrepancies between the raw data and the final report relating to the toxicological impacts of glyphosate.” As a result, in 1983, three of the laboratories’ executives were convicted of fraud.
In a second effort by the company to perform pesticide and herbicide studies, the lawsuit alleges that the hiring of Craven Laboratories in 1991 led to three employees being indicted due to fraudulent laboratory practices along with the owner of the laboratory as well.
The Non-Hodgkin Lymphoma Lawsuit is Case No. 6:18-cv-00253-JA-KRS, in the U.S. District Court for the Middle District of Florida.
