A Los Angeles resident has filed a product liability lawsuit against drug manufacturer Fresenius on behalf of his late wife after she suffered complications allegedly as a result of GranuFlo and/or NaturaLyte in her dialysis treatment.
On Dec. 26, 2011, Sue Washington received her scheduled dialysis treatment at Fresenius Medical Care in California. During her treatment, Sue allegedly suffered ventricular fibrillation and went into cardiopulmonary arrest. She was then transported to the hospital but was pronounced dead upon arrival.
Now, her husband has filed a GranuFlo/NaturaLyte lawsuit against Fresenius, alleging that Fresenius downplayed the risks associated with their dialysis treatment products. He says that if Sue Washington had known of the true facts surrounding NaturaLyte and GranuFlo, she would have never used the dialysis concentrates.
Product Misrepresentation
With phrases of “the safest dry acid product” and “superior clinical outcomes,” who would expect that GranuFlo and/or NaturaLyte could actually increase the risk of cardiac arrest and stroke in users? Both patients and doctors claim they have been misled by the false assurances presented by Fresenius about their dialysis treatment products.
In March 2012, the U.S. Food & Drug Administration (FDA) even released a Class I recall of GranuFlo and NaturaLyte. Class I recalls are the most serious type of recalls, only involving circumstances that cause adverse health consequences.
Internal Memo
Numerous GranuFlo/NaturaLyte lawsuits allege that Fresenius has known about the real risks associated with their products but still continued to market it to the public, selling more each year.
It is even alleged in the complaint that an internal memo dating back to November 2011 clearly indicates that Fresenius knew of the significant increased risk of cardiac arrest. In the memo, it was further explained that risks of cardiac arrest increased 6 to 8 times in patients taking GranuFlo and/or NaturaLyte.
The GranuFlo/NaturaLyte lawsuit has been added to In re: Fresenius GranuFlo/NaturaLyte Dialysate Products Liability Litigation, Case No. 1:13-md-02428-DPW, in the U.S. District Court for the District of Massachusetts.
