A man from California alleges his long term Unum disability benefits were wrongly denied, even though he had met all eligibility requirements. The man alleges the Unum disability benefits denied under wrongful circumstances, including ignoring relevant medical testimony that highlighted the severity of his disability.

Plaintiff Radu M. ultimately alleges he had Unum disability benefits denied in bad faith, which is when the insurance company acts within the best interest of the company and not their policyholder.

According to the Unum claim denial lawsuit, Radu had been previously fully employed as a sales representative for the Hertz Corporation. Radu started his employment on March 19, 1996, and had worked for the company long enough to be eligible for long term disability benefits under the insurance policy.

Radu says he should have been provided short term or long term Unum disability benefits if he became unable to work. This reportedly occurred on July 31, 2014, when Radu became unable to work due to a variety of mental and physical ailments.

These health problems included coronary artery disease, severe kidney damage, retinal detachment, anxiety, and depression, he claims. Radu says his physician had confirmed that he was no longer able to work due to these problems, which prevented him from completing minimal occupational duties.

Overview of Unum Claim Denial Lawsuit

According to the Unum claim denial lawsuit, Radu had submitted a claim for long term disability benefits on Feb. 2, 2015. Even though Radu met all eligibility requirements, he claims the insurance company declared his Unum disability benefits denied.

To be considered eligible for long term disability benefits under Unum’s policy, the claimant must be unable to work in their current occupation and cannot work in a similar occupation that would earn them sufficient income.

Claimants often prove this through medical testimony, which highlights the severity of their disabilities and how it would prevent them from finding work elsewhere. According to the Unum claim denial lawsuit, Radu submitted all this medical testimony to prove the severity of his condition but found his Unum disability benefits denied on Aug. 21, 2015.

Unum reportedly stated that there was not sufficient medical evidence and that Radu did not meet the definition of “disabled” under the insurance policy. Radu immediately filed an appeal of this decision and submitted additional medical evidence that further described his disability.

However, Unum upheld its decision to deny Radu’s long term disability benefits and notified him of this decision on July 6, 2016. At this point in time, Radu says he has exhausted all administrative remedies and has been forced to file legal action against Unum.

Unum is one of the oldest and most well known disability insurance providers in the United States, with over 15 million policyholders. However, Unum has become infamous for allegedly systemically denying claims under bad faith insurance circumstances.

Unum has been allegedly ignoring or pinpointing certain points on the claims for disability coverage, in order to deny the claims. This is an act of bad faith insurance and is devastating to policyholders depending on the disability coverage.

Radu is seeking compensation for all missing Unum disability benefit payments, along with any other relevant damages.
