A Texas man recently filed a new Roundup lymphoma lawsuit against agricultural giant Monsanto, alleging that use of the weedkiller Roundup led to his diagnosis with non-Hodgkin’s lymphoma.
The plaintiff, Donald N., used Roundup on a regular basis for years, his Roundup lymphoma lawsuit claims. He adhered to the warnings, he says, but unfortunately Donald was diagnosed with non-Hodgkin’s lymphoma; he alleges it is a direct result of his exposure to Roundup.
On top of the obvious physical suffering and risk of fatality, Donald says his Roundup lymphoma cancer has also incurred monetary damages. Because of these injuries, Donald turned to litigation against Monsanto, alleging that his lymphoma diagnosis from Roundup use could have been prevented if he had been adequately warned of the serious risks of the carcinogenic product.
Donald filed his Roundup lymphoma lawsuit on March 6, 2018, claiming that Roundup is a defective product that is “dangerous to human health.” The Roundup lymphoma lawsuit was filed on multiple counts, including negligence, design defect, failure to warn, and breach of express and implied warranties.
Background of Roundup Cancer
Monsanto’s popular weedkiller Roundup has been linked with a number of types of cancer, including non-Hodgkin’s lymphoma (NHL). A number of farm workers and home gardeners have filed lawsuits against Monsanto with allegations of Roundup cancer, claiming that they were diagnosed with one of several kinds of cancer after using Roundup.
The Environmental Protection Agency began to suspect a connection between Roundup and cancer since the 1980s. A recent report published in March 2015 by the International Agency for Research on Cancer (IARC) concluded that glyphosate, the active ingredient in Roundup, is linked with cancer.
Types of cancer that have so far been linked with the weedkiller include non-Hodgkin’s lymphoma, leukemia, bone cancer, B-cell lymphoma, multiple myeloma, renal cell carcinoma, and many others.
Filing a Roundup Lymphoma Lawsuit
Monsanto has gone so far as to use the taglines “safer than table salt” and “practically non-toxic” to animals to describe its product, despite allegedly being aware that the risks of Roundup are much greater. Back in 1996 the New York Attorney General actually filed a lawsuit against Monsanto for making these kinds of statements, claiming they were deceptive and dangerous to customers, misleading them about the actual safety of the product.
Donald’s Roundup lymphoma lawsuit alleges that his injuries are like thousands of other Roundup victims in similar situations, and were avoidable with the proper warnings for use.
If you are one of the countless people who use Roundup—either in the course of your employment or for your home garden—and have since been diagnosed with lymphoma or another cancer, you may be able to file a Roundup lymphoma lawsuit.
While filing a lawsuit cannot take away the pain and suffering caused by Roundup-related cancer or bring a loved one back to life, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Roundup Lymphoma Lawsuit is Case No. 4:18-cv-00371-CAS, in the U.S. District Court for the Eastern District of Missouri.
If you or a loved one developed cancer after using Roundup as a farm worker or home gardener, you may have a legal claim. Legal migrant farm workers may also seek help. Learn more by filling out the form on this page for a FREE case evaluation.
