A Louisiana man filed a lawsuit against Ford Motor Company for failing to warn him against an alleged acceleration defect in his Ford motor vehicle.
Plaintiff Ernest J. claims in his Ford sudden acceleration lawsuit that as direct result of the Ford’s failure to warn, he suffered a car accident and sustained permanent disabling injuries.
The incident in question occurred on March 1, 2013, when Ernest was driving on a highway at 55 miles per hour and remained at a steady speed. At some point, the vehicle had started gaining acceleration and would not slow down, despite Ernest’s attempts of stepping on the brake and deploying its emergency brakes.
Ultimately, the plaintiff lost control of his vehicle and had finally stopped when he went off the road, crashing into several trees, according to the Ford sudden acceleration lawsuit. While the vehicle sustained significant damage, Ernest had to be transported by ambulance to the hospital, where he reportedly needed intense medical care for one week.
According to the medical report, the plaintiff suffered numerous injuries including head trauma, back injury, vision damage in his right eye, and is now at least partially disabled.
With these new disabilities, Earnest was forced to quit his job and has been unable to earn sufficient income. Since the accident, he has incurred massive debts from due to medical expenses, according to the Ford acceleration lawsuit.
Ernest is filing this Ford lawsuit, claiming the automaker’s negligent decision of not informing him and other consumers of the acceleration defect in certain models of their vehicles.
In July 2014, over a year after the car accident, Ernest received a letter from Ford, informing him that numerous Ford vehicles had problems with sudden acceleration. Apparently, over 30 Lincoln, Mercury, and Ford 2002-2010 vehicle models may suffer from defective Speed Control Deactivation Switches.
This mechanism controls the acceleration rate of the vehicle. Prior to receiving the letter, the plaintiff reportedly had no knowledge of any acceleration complications with his vehicle. Ernest is filing this Ford sudden acceleration lawsuit because he had been under the impression that the brake problem was a random event, not a problem that the company had known about.
At this time, Ernest’s injuries have not been resolved, so he could incur future medical bills, but the amount in damage claims could be as high as $2 million. The charges he is bringing against Ford Motor Company include: negligence, concealing information, and misrepresenting a product.
This Ford Acceleration Lawsuit is Case No. 3:14-CV-2668, in the U.S. District Court for the Western District of Louisiana, Monroe Division.
Overview of Ford Acceleration Complications
Owners across America are facing an alarming prospect, as the car company recently announced that over 30 of their vehicle models may have a dangerous acceleration defect. Ford has already been hit with multiple Ford class action lawsuits for allegedly concealing vital safety information from their customers and for negligently causing avoidable injuries.
Experts are warning consumers who drive certain Ford, Mercury or Lincoln vehicles that they may lose control of their acceleration and become involved in a serious car accident.
According to experts, the sudden acceleration of these Ford vehicles is caused by a design flaw that allows the electronic throttle system to take control of the accelerator, away from the driver.
At this point, the vehicle begins accelerating on its own and the drivers have no way to stop it. This ultimately puts the driver, passenger, and pedestrians in danger of serious or fatal injuries. Several Ford acceleration lawsuits note that the company installed a brake override system in cars manufactured in 2010, but did not update their older models to include this feature.
Due to this decision, many customers not only allegedly suffered physical injuries from avoidable car crashes, but also suffered significant financial damages. Not only did some of these consumers suffer massive hospital bills, but they often found that their cars were not worth fixing because the repair costs exceeded the purchase price.
Consumers who have filed Ford lawsuits claim that the company knew about this acceleration problem but deliberately hid it from potential buyers in order to protect their profit margin.
In general, Ford sudden acceleration lawsuits are filed individually by each plaintiff and are not class actions.
