A new class action lawsuit alleges that LA Fitness sent unwanted marketing text messages to consumers, even after they opted out of receiving them.
Plaintiff Anthony Bahar filed the LA Fitness class action lawsuit on Sept. 14 in California federal court, alleging violations of the Telephone Consumer Protection Act (TCPA).
Bahar alleges that LA Fitness sent him unsolicited text messages promoting its gym services despite his explicit request to opt out. He asserts the TCPA was enacted to protect consumers from unwanted telemarketing calls and text messages.
According to the complaint, Bahar opted out of receiving LA Fitness’s text messages on July 30, 2026, by replying with a stop instruction. However, he says the company ignored his request and continued to send him marketing messages, including one on Aug. 25, 2026.
Bahar claims that LA Fitness’s conduct constitutes a direct TCPA violation because the TCPA mandates that companies must honor opt-out requests and cease sending marketing communications to consumers who have opted out.
Bahar seeks to represent anyone in the United States who, within four years prior to the filing of the lawsuit, received two or more text messages from LA Fitness after opting out.
LA Fitness allegedly failed to implement proper opt-out procedures
The LA Fitness class action lawsuit further alleges that the gym failed to implement the necessary procedures to honor opt-out requests, including maintaining a do-not-call list and training its personnel on how to use it.
Bahar claims that these repeated TCPA violations resulted in continued harassment and invasion of privacy for himself and potentially thousands of other consumers.
He is suing for TCPA violations and seeking certification of the LA Fitness class action, $500 in damages per call, up to $1,500 per call for willful or knowing violations of the TCPA and injunctive relief to stop the company from sending unwanted text messages.
In addition to seeking damages, Bahar is also requesting injunctive relief to compel LA Fitness to comply with the TCPA’s requirements and cease sending unwanted text messages to consumers who have opted out.
In 2020, LA Fitness was also hit with a class action lawsuit alleging the gym sent multiple unsolicited coupons by text to consumers.
