A Nevada state jury awarded $230 million to a group of 15 individuals arguing it suffered liver damage as a result of consuming the now-defunct Real Water alkaline water.
The group of plaintiffs included UFC fighter Gray Maynard, who argued drinking the water caused him to lose a match.
The group also claimed Real Water’s alkalization process produced the toxic chemical hydrazine in the water, Law360 reports.
Consumers reportedly started hospitalizations in the latter half of 2020, prior to Real Water owner AffinityLifestyles.com Inc. recalling the product in March 2021 in the wake of a multistate health investigation.
Plaintiffs receive additional Real Water verdict of $5B in punitive damages
Joel Odou, a Real Water defense lawyer, reportedly argued to past juries that punitive damages were not warranted because no one involved with making Real Water expected, anticipated or understood hydrazine would be present in the product.
However, following the $230 million Real Water verdict, the plaintiffs went to a punitive damage phase where they received an award of $5 billion in punitive damages, Law360 reports.
A jury in Las Vegas awarded the $3 billion verdict earlier this year to a group of five children and three adults who argued they developed liver issues after drinking Real Water’s alkaline water product.
