A California federal judge has granted final approval to a $4 million class action settlement reached between Barbara’s Bakery and customers who purchased certain products between 2008 and 2013. Consumers have until Wednesday, Jan. 1, to file a claim to receive up to $100 from the class action settlement.
The Barbara’s Bakery class action settlement resolves allegations that the company mislabeled its cereal and snack products as “all natural” when some of them contain genetically modified (GMO) ingredients.
Class Members of the Barbara’s Bakery settlement include all U.S. consumers who purchased eligible products from May 23, 2008 through July 5, 2013. These products include cereals, cereal bars, fig bars, cheese puffs, granola bars, Snackimals animal cookies, organic mini cookies, snack mixes and crackers. See the full list of eligible products. Detailed claim filing instructions can be found here.
Class Members that submit a valid Claim Form no later than Jan. 1, 2014 will get up to $100 to reimburse the money they paid to purchase these products. The amount of money you may receive will depend on the total amount of money you spent on the eligible products during the Class Period.
In addition to approving the reimbursement payments to consumers, the judge also approved attorneys’ fees and expenses in the amount of $1 million, and an incentive award of $2,500 for the lead plaintiff. Barbara’s Bakery will also remove the terms “all natural,” “no artificial additives,” “no artificial preservatives” and “no artificial flavors” from its packaging on foods that contain GMOs or artificial ingredients.
Barbara’s Bakery makes no admission of wrongdoing in agreeing to the class action settlement, and approval of the deal does not mean the judge found the company to be at fault.
