interior cab of a jeep vehicleThe transmission found in Jeep Cherokee vehicles is defective and increases the risk for accident and injury, according to a class action lawsuit recently filed by a disgruntled consumer.

Plaintiff Lisa Cummings filed the Jeep class action lawsuit against FCA US LLC over claims that the 9-speed transmission found in the 2016 Jeep Cherokee is defective and consistently fails to shift into the desired gear.

Cummings says she purchased a 2016 Jeep Cherokee in January 2016, believing that the vehicle was “safe and reliable and, therefore, a good value.”

However, she allegedly soon began experiencing problems related to the 9-speed transmission installed in the vehicle. Cummings claims that the vehicle fails to reliably switch gears or stay in the desired gear. For example, it reportedly takes more than a minute for the vehicle to shift from reverse to drive.

In multiple instances, Cummings’ vehicle suddenly accelerated or decelerated due to the alleged transmission issue. During one dramatic instance, Cummings says she was driving down the freeway with her grandchildren at a speed of around 70 miles per hour. The vehicle suddenly downshifted and decelerated to a speed of around 25 miles per hour.

A semi-truck which was driving behind Cummings nearly hit her vehicle as a result of the alleged transmission failure. Cummings says she now feels unsafe driving her Jeep Cherokee and does not use the vehicle on the highway.

Due to the faulty transmission and dangerous defect, Cummings returned to the dealership and told the employees about her vehicle problems. The dealership allegedly flashed her vehicle and told her it would not be a problem anymore.

However, the Jeep Cherokee class action lawsuit claims the problem persisted. Cummings reportedly returned to the dealership eight times between January 2016 and January 2018 in an attempt to fix the issue. However, the dealership allegedly failed to acknowledge the transmission issue and did not fix the dangerous problem.

The Jeep Cherokee transmission class action claims that FCA knew or should have known that their 9-speed transmission found in Jeep Cherokee vehicles was defective, but concealed the dangers in order to entice consumers to purchase their vehicles.

“The existence of the Defect is a material fact that a reasonable consumer would consider when deciding whether to purchase or lease a Class Vehicle,” the Jeep Cherokee class action claims. “Had Plaintiff and Class Members known that the Class Vehicles were equipped with defective transmissions they would not have purchased or leased them or would have paid less for them.”

A settlement has been reached over similar allegations regarding Fiat Chrysler vehicles. The settlement was proposed in February after almost three years of litigation. Should the settlement be approved, it will provide an extended warranty, cash payment of up to $2,000, or a trade-in voucher for up to $4,000.

Cummings seeks to represent a Class of consumers who purchased or leased a 2016 Jeep Cherokee equipped with the 9-Speed Transmission. She also seeks to represent a subclass of the same consumers who live in New York or purchased their vehicle in New York.

The Jeep Cherokee class action lawsuit seeks compensatory damages, treble damages, statutory damages, punitive damages, restitution, disgorgement, court costs, and attorneys’ fees.

    I have been noticing that twice the transmission has shifted to slow down and the other felt liked it slipped and wanted to hydroplane on a dry surface

    I bought a 2015 jeep Cherokee in 2014. The jeep would lose speed & completely lock up. I qas so afraid. I took it the dealership several times and was so overwhelmed. It got to the point were I traded it in for a 2017.

    The same exact thing happened to my 2016 Jeep Cherokee while driving on the highway while on vacation in Massachusetts it had to go to the shop and was serviced but the service shifter light is still on and transmission was never serviced also when shifting from reverse to drive it You can feel the transmission slip often. Does anyone know how I can get involved in this settlement? Do I have to be a resident of New York?

    My Father had just bought a Patriot three years ago, he was leaving the dealership for a reason unknown to us. It had to be mechanical in nature as he had paid cash for it. He was killed at their intersection when leaving as the vehicle either ran it or failed to accelerate. He was a diligent diver and would never not yield to a stop sign as the report indicates. It will take some investigation in our case as he was hit on the driver side and trapped for 45 minutes and died of head trauma before extracted. No autopsy was determined by whom ever does that? When I called the deallership to make sure of his financial obligations they were the only ones who said nothing if remorse of his death right in front of their dealership. We had strangers stopping and wishing us their condolences as we put flowers at the sight his vehicle landed 4 lanes plus a center lane to the grass across the road, that is how bad the accident was. I have always thought there was something that went wrong with that vehicle as line of sight was absolutely clear. I don’t even know the transmission type as it was so new I hadn’t had an opportunity to drive it and no one would let me see the vehicle because of the blood involved.

    Please add that I have a 2014 Jeep Cherokee Lattitude 4 ad and it was doing the same thing. I took it in due to a recall they say they fixed it but it is doing the same thing. I believe those of us that own them are in serious danger!! How do we get this listed as a “RECALL” ??ASAP!!!!

      I bought a brand new jeep Cherokee latitude I think in October 2014. It was a 2015 Cherokee. At 200 some miles I noticed some funny things going on
      Like jerking when put in reverse. I used to work at a dealership and it was always the transmission. But the car was new. At 4,000 miles still under warranty the jeep stopped shifting into gear, the “D” light was on and it wouldn’t run. And it jerked all the way to the dealership. Luckily I was parked at my mailbox and not on a highway. I will never trust Jeep again, ever. I had the transmission replaced under warranty and as soon as I could I traded it in for a Subaru. Even though it depreciated value like 16k right off the lot. Jeep is a joke.

      You can usually look up a recall or call your dealership with your VIN # and they will tell you if you have an open recall.
