Plaintiff Lisa Cummings filed the Jeep class action lawsuit against FCA US LLC over claims that the 9-speed transmission found in the 2016 Jeep Cherokee is defective and consistently fails to shift into the desired gear.

Cummings says she purchased a 2016 Jeep Cherokee in January 2016, believing that the vehicle was “safe and reliable and, therefore, a good value.”

However, she allegedly soon began experiencing problems related to the 9-speed transmission installed in the vehicle. Cummings claims that the vehicle fails to reliably switch gears or stay in the desired gear. For example, it reportedly takes more than a minute for the vehicle to shift from reverse to drive.

In multiple instances, Cummings’ vehicle suddenly accelerated or decelerated due to the alleged transmission issue. During one dramatic instance, Cummings says she was driving down the freeway with her grandchildren at a speed of around 70 miles per hour. The vehicle suddenly downshifted and decelerated to a speed of around 25 miles per hour.

A semi-truck which was driving behind Cummings nearly hit her vehicle as a result of the alleged transmission failure. Cummings says she now feels unsafe driving her Jeep Cherokee and does not use the vehicle on the highway.

Due to the faulty transmission and dangerous defect, Cummings returned to the dealership and told the employees about her vehicle problems. The dealership allegedly flashed her vehicle and told her it would not be a problem anymore.

However, the Jeep Cherokee class action lawsuit claims the problem persisted. Cummings reportedly returned to the dealership eight times between January 2016 and January 2018 in an attempt to fix the issue. However, the dealership allegedly failed to acknowledge the transmission issue and did not fix the dangerous problem.

The Jeep Cherokee transmission class action claims that FCA knew or should have known that their 9-speed transmission found in Jeep Cherokee vehicles was defective, but concealed the dangers in order to entice consumers to purchase their vehicles.

“The existence of the Defect is a material fact that a reasonable consumer would consider when deciding whether to purchase or lease a Class Vehicle,” the Jeep Cherokee class action claims. “Had Plaintiff and Class Members known that the Class Vehicles were equipped with defective transmissions they would not have purchased or leased them or would have paid less for them.”

A settlement has been reached over similar allegations regarding Fiat Chrysler vehicles. The settlement was proposed in February after almost three years of litigation. Should the settlement be approved, it will provide an extended warranty, cash payment of up to $2,000, or a trade-in voucher for up to $4,000.

Cummings seeks to represent a Class of consumers who purchased or leased a 2016 Jeep Cherokee equipped with the 9-Speed Transmission. She also seeks to represent a subclass of the same consumers who live in New York or purchased their vehicle in New York.

The Jeep Cherokee class action lawsuit seeks compensatory damages, treble damages, statutory damages, punitive damages, restitution, disgorgement, court costs, and attorneys’ fees.

    My 2015 Jeep does the exact same thing. The 9 speed is very dangerous. Jeep will not do anything about it either.

      I had a 2015 Cherokee latitude bought brand new. They ended up replacing the transmission but I never trusted jeep again and got rid of it as soon as I could.

    I have an 07 and it does the same thing. Was going down the HWy and it slowed to 35 mphs. I was in the fast lane trying to get over to the shoulder

    I have a 2015 and I was on my way home from from taking my son to the hospital and my car went from the speed limit of 75 mph down to 30 mph on the fwy before I could find an exit. I was almost hit several times. Something needs to be done about this

    Mine is terrible! I bought mine at the end of July and was told the shifting and slow accelerating is due to the car switching to save on gas… but my jeep does not turn off and start like an eco car. I complained to my dealer and that was what iw as told. The car does not shift right in my opinion it shifts hard and being that I am a younger girl no one will listen to me.

          I have the 2014 Jeep Cherokee trailhawk. It’s had nothing but issues with the transmition. Sounds like this is an all around issue with this year and model

    I drive an 09 jeep Patriot n it does the same thing. On 2 occasions it happened with me n my children in the car and we almost got ran off the road by a semi truck. After 9 visits back to the dealership, other mechanics and no resolve n calling the manufacturer, I was told there was nothing anyone could do so I had no choice but to trade out of it into another vehicle. The CVT transmission in these is garbage, the vehicle is simply to large of a load for these vehicles to maintain 70 or higher for long periods of time. They are death traps! I will never buy jeep again. I’m out $10,000.00 because of my purchase of the Jeep in Jan 2018 and having to trade out of it to be in a safer car for me n my kids just 6 months of payments. I sure hope they pay for the crap they put out there.

    I’m leasing a 2016 JGC and it has the same issues. Tranny gets stuck in either high or low at times. very scary when it happens.

    I purchased a new 2015 Jeep Cherokee. I have taken it back and documented my complaints about the hard shifting and slow response accelerating. It has issues around shifting. I had to get a new shifter in 2016.
    Every time I take it to the dealer they flash it/update it and tell me it will be better. Nope. It is not. Frustrating. I have an automatic that shifts like bad manual.

      I JUST bought a 2015 because I was in such a crunch to get rid of my lease and get into car and I didn’t want to lease again so I bought a 2015 Jeep Cherokee under a crunch from a friend who owns a dealer however it is the worst car I have ever driven. It shifts terribly and to accelerate is also an issue. there is something wrong it DOES NOT work properly and I said that within a week of purchasing it however when I went to take it back it was too late and never heard back other then it was because the car was trying to save on gas.
