interior cab of a jeep vehicleThe transmission found in Jeep Cherokee vehicles is defective and increases the risk for accident and injury, according to a class action lawsuit recently filed by a disgruntled consumer.

Plaintiff Lisa Cummings filed the Jeep class action lawsuit against FCA US LLC over claims that the 9-speed transmission found in the 2016 Jeep Cherokee is defective and consistently fails to shift into the desired gear.

Cummings says she purchased a 2016 Jeep Cherokee in January 2016, believing that the vehicle was “safe and reliable and, therefore, a good value.”

However, she allegedly soon began experiencing problems related to the 9-speed transmission installed in the vehicle. Cummings claims that the vehicle fails to reliably switch gears or stay in the desired gear. For example, it reportedly takes more than a minute for the vehicle to shift from reverse to drive.

In multiple instances, Cummings’ vehicle suddenly accelerated or decelerated due to the alleged transmission issue. During one dramatic instance, Cummings says she was driving down the freeway with her grandchildren at a speed of around 70 miles per hour. The vehicle suddenly downshifted and decelerated to a speed of around 25 miles per hour.

A semi-truck which was driving behind Cummings nearly hit her vehicle as a result of the alleged transmission failure. Cummings says she now feels unsafe driving her Jeep Cherokee and does not use the vehicle on the highway.

Due to the faulty transmission and dangerous defect, Cummings returned to the dealership and told the employees about her vehicle problems. The dealership allegedly flashed her vehicle and told her it would not be a problem anymore.

However, the Jeep Cherokee class action lawsuit claims the problem persisted. Cummings reportedly returned to the dealership eight times between January 2016 and January 2018 in an attempt to fix the issue. However, the dealership allegedly failed to acknowledge the transmission issue and did not fix the dangerous problem.

The Jeep Cherokee transmission class action claims that FCA knew or should have known that their 9-speed transmission found in Jeep Cherokee vehicles was defective, but concealed the dangers in order to entice consumers to purchase their vehicles.

“The existence of the Defect is a material fact that a reasonable consumer would consider when deciding whether to purchase or lease a Class Vehicle,” the Jeep Cherokee class action claims. “Had Plaintiff and Class Members known that the Class Vehicles were equipped with defective transmissions they would not have purchased or leased them or would have paid less for them.”

A settlement has been reached over similar allegations regarding Fiat Chrysler vehicles. The settlement was proposed in February after almost three years of litigation. Should the settlement be approved, it will provide an extended warranty, cash payment of up to $2,000, or a trade-in voucher for up to $4,000.

Cummings seeks to represent a Class of consumers who purchased or leased a 2016 Jeep Cherokee equipped with the 9-Speed Transmission. She also seeks to represent a subclass of the same consumers who live in New York or purchased their vehicle in New York.

The Jeep Cherokee class action lawsuit seeks compensatory damages, treble damages, statutory damages, punitive damages, restitution, disgorgement, court costs, and attorneys’ fees.

    I have a 2015 Jeep Cherokee Trailhawk. I just received quote from dearlership to fix transmission for $10789. This is just wrong. I have had nothing but issues since buying this brand new. I am devestated that this is happening. I cannot afford to fix. I do not feel safe driving it either but have no choice.

    I have a 2015 Jeep Latitude and have had multiple issues with the transmission shifting roughly. The car also accelerates when in cruise control having caused several near misses. When I take the car to the Jeep dealer they run the codes and tell me nothing is wrong. I would be interested in being included in this class action, thank you.

    I own a 2015 Jeep Grand Cherokee with 95k miles. My transmission failed two weeks ago and I had the vehicle towed to the Jeep dealership where I purchased it from. I was told they only have one qualified transmission technician and 5 vehicles with similar problems in the queue in front of me. They finally inspected the transmission yesterday and were told it needs to be replaced. I was also told these transmissions are on backorder with no delivery date so I could be waiting a month or longer for repairs. In addition, I was experiencing an engine tapping noise, which was diagnosed as requiring rocker arm/camshaft replacement. This appears to be another well-documented problem with these 2015 Jeep Grand Cherokee vehicles. Together these repairs are in the thousands of dollars, not including the cost of a rental vehicle that I will need for a month or longer. I contacted Jeep USA to see if they would offer any assistance and they flatly refused me.

    I own a 2017 Jeep Grand Cherokee Summit since new. My wife uses the car as a daily driver to her job at a Doctors office.

    Unfortunately, my wife has complained from NEW that strange things were going on with this vehicle but every time I rode with her, it seemed to work fine.

    Finally, while driving on a road trip, I experienced the problem when we stopped for gas and the transmission acted abnormally. I shut the car down and restarted and shifted into gear and proceeded on our trip without further incident; however, upon returning home, the car began to routinely act up when cold starting and shifting the transmission to get it out of the garage.

    Loud clunking noises were emanating from the transmission as it was shifted from park to reverse and then reverse to drive. It continued this behavior until the dash light said FCW requires immediate service.

    Now the dealer tells me Fiat sold Jeep to Peugeot and the “lifetime bumper to bumper warranty” I bought when the vehicle was new is owned by a 3rd party that interprets and approves all warranty claims and they can take up to a month to get resolved but the warranty only provides a “5 day rental car service as part of the warranty.” Further, I am told the parts must come from Europe and they are all on back order!

    I have owned 5 Jeeps over the past 25 years, some with over 250,000 miles and still running strong when I sold them. Today, Jeep is NOT AN AMERICAN VEHICLE and its ‘ruggedness has been torn out of it by the use of INFERIOR parts.

    I worked for the auto industry as an engineer when Bob Eaton, a fellow Jayhawker, sold Chrysler to Mercedes and took his money and bought a yacht and sailed into the sunset, essentially destroying an American icon that proved itself in World Wars as reliable.

    Now Europe owns the vehicle, and based on all complaints I see, has made a mockery of this vehicle and its subsystems.

    What does it take to join the CLASS ACTION LAWSUIT and hopefully it includes a lawsuit against Mercedes (their transmission design I understand) and Fiat and Peugeot!

    Fighting to get my Jeep fixed so I can get rid of it and buy a Ford!

    I have a 2017 Grand Cherokee that had zero issues up until about a month ago when my transmission randomly went out. I was accelerating out of a parking lot going 10 MPH and my car “caught” and immediately was flashing “service trans.”

    It’s been a month since that happened and my Jeep is just now finished. Total cost was around $3,000.

    My husband & I purchased a 2015 Jeep Cherokee latitude in 2018 I started noticing some problems with shifting and exceleration I just thought is was because I wasn’t used to driving it but the problem started to get worse, and in 2019 my husband had a major stroke and was left not being able to walk or talk so I had to start driving the car a lot more, and the problem with shifting and stalling got worse my husband and I are seniors and disabled so with that being said we are on a very tight budget but it’s become dangerous for me to drive the car because of hard shifting problems and the car jumping out of gear and jerking. I went to the store and when I came out the car wouldn’t start and it was raining so a gentleman help me get the car started I went home and turned the car off and tried to restart it and found that the battery was completely dead I took it to a mechanic and at first he said all I needed was a new battery so I bought a new battery and after he installed it he also did a diognostic because of some problems I mentioned and couldn’t find anything wrong until I tried to drive away my gear locked up in neutral and wouldn’t shift or turn off so he offered to do a system update because he thought because of the battery issues that the transmission module wasn’t communicating with the computer or something but the flash didn’t work, he said my transmission module was bad so he said it would cost in the thousands of dollars to fix the problem and needless to say I was heart broken because my husband is retired and a veteran I’m also retired and we are on a very tight fixed budget, so I called the dealership and had the car towed to them so now I’m just praying for a merical because it’s our only vehicle to get around especially for my husband because he has cancer so getting him to his appointments are very important, so I would like to be added to this class action suit, we’ve been having problems since 2018 and now it’s 2021 and the car is still not working. Thank you

    I have a 2014 Jeep Cherokee with only 32,000 Miles on it and the transmission failed. I need to know if there are any class action suits that are including my 2014. It is costing me $4600 to have remanufactured transmission installed by dealership.
