Plaintiff Lisa Cummings filed the Jeep class action lawsuit against FCA US LLC over claims that the 9-speed transmission found in the 2016 Jeep Cherokee is defective and consistently fails to shift into the desired gear.

Cummings says she purchased a 2016 Jeep Cherokee in January 2016, believing that the vehicle was “safe and reliable and, therefore, a good value.”

However, she allegedly soon began experiencing problems related to the 9-speed transmission installed in the vehicle. Cummings claims that the vehicle fails to reliably switch gears or stay in the desired gear. For example, it reportedly takes more than a minute for the vehicle to shift from reverse to drive.

In multiple instances, Cummings’ vehicle suddenly accelerated or decelerated due to the alleged transmission issue. During one dramatic instance, Cummings says she was driving down the freeway with her grandchildren at a speed of around 70 miles per hour. The vehicle suddenly downshifted and decelerated to a speed of around 25 miles per hour.

A semi-truck which was driving behind Cummings nearly hit her vehicle as a result of the alleged transmission failure. Cummings says she now feels unsafe driving her Jeep Cherokee and does not use the vehicle on the highway.

Due to the faulty transmission and dangerous defect, Cummings returned to the dealership and told the employees about her vehicle problems. The dealership allegedly flashed her vehicle and told her it would not be a problem anymore.

However, the Jeep Cherokee class action lawsuit claims the problem persisted. Cummings reportedly returned to the dealership eight times between January 2016 and January 2018 in an attempt to fix the issue. However, the dealership allegedly failed to acknowledge the transmission issue and did not fix the dangerous problem.

The Jeep Cherokee transmission class action claims that FCA knew or should have known that their 9-speed transmission found in Jeep Cherokee vehicles was defective, but concealed the dangers in order to entice consumers to purchase their vehicles.

“The existence of the Defect is a material fact that a reasonable consumer would consider when deciding whether to purchase or lease a Class Vehicle,” the Jeep Cherokee class action claims. “Had Plaintiff and Class Members known that the Class Vehicles were equipped with defective transmissions they would not have purchased or leased them or would have paid less for them.”

A settlement has been reached over similar allegations regarding Fiat Chrysler vehicles. The settlement was proposed in February after almost three years of litigation. Should the settlement be approved, it will provide an extended warranty, cash payment of up to $2,000, or a trade-in voucher for up to $4,000.

Cummings seeks to represent a Class of consumers who purchased or leased a 2016 Jeep Cherokee equipped with the 9-Speed Transmission. She also seeks to represent a subclass of the same consumers who live in New York or purchased their vehicle in New York.

The Jeep Cherokee class action lawsuit seeks compensatory damages, treble damages, statutory damages, punitive damages, restitution, disgorgement, court costs, and attorneys’ fees.

    We have a 2011 Grand Cherokee Overland. Bought in 2015 with a warrantee. My Wife drives it like a baby. Nothing but problems. Now the transmission just fail. Dealer where we have service said it needs a new one. We have dumped thousands into this money pit. told $ 8300.00 for a new transmission. how do we join the fight?

      I’m having problems with my 2015 jeep trail hawk transmission slips and pulls really hard when I start to accelerates then it makes a thunk noise and take some time to get up to speed now my 4 wd light came on saying 4wd is unavailable and then my 4wd ligtowiyh another saying came on that said 4wd over heating not available something in that term and brought it in and said it was the transfer case that needs to be replaced and will cost $3000 to fix it and I’ve only had this vehicle for 4 months I’m very disappointed and am scared to drive it anymore not sure what will happen next and I have kids very dangerous vehicle!!!!

    I have a 2015 Jeep latitude, I have transmission troubles, lights flashing and it bucks, won’t shift into drive sometimes or reverse. I want to be added also.

    2014 Jeep SRT 27k miles. Just picked up jeep at dealer to resolve multiple warning lights. At red lght behind truck, foot on brake and it just went full speed into back of flat bed. My car was totaled. My leg had hairline fracture and fully broke weeks later. Spent month in hospital. Accident 4/12/2021

    I just bought a 2016 jeep Cherokee and it’s been having issues shifting into gear and slowing down while on the highway to the point it’s dangerous I need in on this lawsuit!

    I brought a used 2016 Jeep Cherokee with low mileage A year after buying the vehicle the Transmission has started to act up The Transmission has a Delay Hesitation &/or Slowness when pull out onto a highway from a light or corner I brought a 6 years Major Part Warranty when I purchased the Jeep Cherokee I see that this is an issue with other owners What should I do in my case, Try to get that Warranty to be honored by the dealership from where I purchased the vehicle Or should I join the Class Action Law Suit going on just in case I get no where with the dealership

    I would like to be included. I have a 2014 Jeep Cherokee that the transmission shifts to neutral, stalls, vibrates and runs roughly. My 19 year old daughter drives this car and it has stalled out and she has to shut the car off and restart to be able to shift back to drive
