Customers reached a $1.5 million deal with HP ending a class action lawsuit over third party ink cartridges and an allegedly fake error message that would stop consumers from being able to use them.

The HP ink cartridge monopoly class action settlement, if approved, will end claims that the printer company installed firmware, called “dynamic security,” into HP printers that stopped customers from being able to use non-HP ink cartridges.

The class action lawsuit alleged that the use of firmware to force consumers to only use HP ink was illegal. Further, alleged that plaintiffs, the HP firmware allegedly caused the printers to display error messages when non-HP cartridges were installed, making customers think that the cartridges were defective.

Earlier this year, HP asked a federal judge to dismiss the class action lawsuit; however, U.S. District Judge Edward Davila tossed HP’s argument, though some claims were trimmed from the case.

Under the terms of the HP ink cartridge monopoly class action settlement, HP is barred from using the so-called dynamic security program on affected printers. Additionally, Class Members will be able to make a claim for a cash payout from the settlement fund.

“First, the settlement achieves the goal of the litigation by eliminating the threat of forcible printer disablement for all members of the class,” state the plaintiffs’ in the motion for preliminary approval of the settlement agreement.

“Second, just as they would have been able to come forward to claim individual damages had they prevailed on common liability issues at trial, the settlement allows class members who lost money or time because of HP’s printer disablements to make a claim for full recovery of their losses.”

The number of Class Members is estimated to be about 50,000, according to the HP ink cartridge monopoly class action settlement.

“The settlement avoids protracted litigation while delivering all or most of the relief class members could expect to obtain at trial,” notes the plaintiffs’ motion for preliminary approval of the HP ink cartridge monopoly class action settlement.

Class Members will receive a part of a $1.5 million settlement fund under the terms of the HP ink cartridge monopoly class action settlement.

“On the optimistic assumption that 20 percent of these class members make a claim, the average payment per class member would be $150. Had plaintiffs prevailed at trial on the common liability issues, under plaintiffs’ trial plan, individual class members would have been able to submit proof to recover their out-­of­-pocket expenses in proceedings following the class trial,” notes the motion for preliminary approval of the HP ink cartridge monopoly class action settlement.

“While such individual expenses vary, a full set of HP replacement cartridges costs about $100 and a replacement HP printer costs about $150.”

    Instant ink is the worst, when you need to print as urgent. I buy it in later 2019, developer a Salon Business from home to storefront, wanted to advertise a market, and I needed a couple of printing documents for urgent right away, marketing material and he could not do it. It failed me and I couldn’t understand for two days why it would not print until I called them and they gave me the story about why I cannot print. After arguing with the customer service and had to apologize at the end because I know it’s not her, it is the company itself. I was so pissed and it happened to me twice me
    I lost money because I could not market myself. I lost money because I wasn’t able to print when a client needed something in writing of my services as well as that a brochures of my service & prices. I never got a heads up. I didn’t know that it was going to shut off. I was very busy developing my business, and it came to a moment where I couldn’t even print my material.

    and made me lose opportunity where it made me lose money..

    HP is holding my second printer hostage right now.When I called the tech business they have, they played dumb about the issue
    They said I needed a new printer but I had to send my ” broken” one to them. They took my new printer the one I got from them was re-furbished
    Cheap skates for sure

    Please add me to this case. So many problems with the ‘instant ink’ program. The printer is entirely useless and worthless if you stop subscription. I don’t need ink to scan a document but yet the printer is forcing you to re-enroll in the subscription. And also, multiple printer errors start arising when you quit their program.

    I pay a monthly fee for ink if they don’t get paid for whatever reason my printer or any cartridges I have recieved from them, DONT WORK!! Not to mention every page you print counts toward the package you pay for monthly if you go over they double charge you for each page!! If you buy a different cartridge from store they won’t work it’s ridiculous!!

    I have an HP 6968 and I am a subscriber of Instant Ink, is this printer eligible. I pay a monthly fee for ink cartridges.

    This is my second HP printer. I have problems printer almost every time. It failed to send me ink shipments a few times and a few times I didn’t get the HP ink they supposively sent. The some ink they sent didn’t work and it’s HP ink!?
    Please add me to the lawsuit.

    Insta ink does not send ink and there is no way to request new cartridges. They also charge you each month by how much you print. I am being charged to use a printer I already paid for

    I have the instant ink program and am charged every month for ink, however when I need ink I have to run out and then call to het it sent.

    Have HP instant ink and was getting charge 2 -3 times in a mouth then they said they would refund me 5 payments then I see 5 negative payments then 5 plus payment I didn’t get no refunds back money but the pulled out my bank and put it back like they gave me a refund
