HP printer owners may be able to take advantage of a $1.5 million class action settlement resolving claims that consumers who tried to use a non-HP ink cartridge would get a fake error message.
If you owned certain HP OfficeJet and/or OfficeJet Pro printers between March 1, 2015 and Dec. 31, 2017 and experienced trouble printing while using a non-HP ink cartridge, you could get cash from this settlement.
The HP class action settlement was reached after consumers accused the tech company of installing HP firmware, called “Dynamic Security,” on certain printers that made it impossible to use any other brand of printer ink.
According to the class action lawsuit, Dynamic Security caused HP printers to display a fake error messages when non-HP printer ink cartridges were used — causing consumers to think that the ink cartridges were faulty. The HP firmware allegedly affected thousands of Class Members.
The plaintiffs also accused HP of funneling money from ink cartridge sales into their own pockets. In fact, according to the class action lawsuit, HP made more money from ink sales than printer sales due to Dynamic Security’s firmware.
The HP firmware class action lawsuit survived a motion to dismiss, and the parties agreed to settle in 2018.
In addition to paying $1.5 million to end the class action lawsuit, HP has also agreed to a prohibition on the use of its firmware, Dynamic Security.
Class Members can claim reimbursement for expenses incurred due to printing interruption they experienced because of an error message they received while using a non-HP ink cartridge in their HP printer.
Expenses can include costs related to printer repair, time spent dealing with the printer interruption, cartridge replacement, or even a replacement printer.
Documentation of expenses is not required for Class Members to make claim; however, those Class Members who can provide proof of printer interruption expenses will be paid out of the settlement fund first.
Then, if there are funds left over, claims without documentation will be divided equally among Class Members.
Class Members have until March 13, 2019 to exclude themselves from the HP firmware class action settlement and until March 26, 2019 to object.
Who’s Eligible
Class Members include those who “owned a Class Printer during the period from March 1, 2015 through December 31, 2017.”

Potential Award
$100 to $150, though payments will vary based on the number of valid claims and actual out-of-pocket expenses.
Class Members can get reimbursed for costs related to the print interruption including buying new ink cartridges, a new printer, or hiring printer repair services, as long as they provide documentation for the out-of-pocket expenses.
According to the motion for preliminary approval of the HP class action settlement, about 50,000 customers may be eligible to file a claim.
“On the optimistic assumption that 20 percent of these class members make a claim, the average payment per class member would be $150…While such individual expenses vary, a full set of HP replacement cartridges costs about $100 and a replacement HP printer costs about $150,” the motion for preliminary approval states.
Proof of Purchase
Printer model, the month and year of the printer interruption, and the brand of non-HP printer ink used. Documentation of expenses related to the printer interruption is not required; however, Class Members who provide documentation will be paid out of the settlement fund before non-documented claims.
Documented claims require receipts, photographs, debit/credit card statement of out-of-pocket expenses that relate to print interruption including buying a new ink cartridge, replacement printer, or printer repair services.

Easy Fix
DO NOT BUY HP PRODUCTS OR PRINTERS
They are apparently at it again even after previous rulings and settlements. A new firmware update dated 20201120 has bricked my HP printer. What is my recourse?
I didn’t apply for this settlement because I didn’t keep receipts. But I did throw away new perfectly good off-brand cartridges when they were rejected by my HP OfficeJet Pro 8620. Now the printer is acting up saying that the printhead is missing, not detected or not installed properly.
My HP Officejet Pro 7740 is held hostage! I was part of the above class action suite and was awarded money. Now HP is still doing it! How can they be sued again? Even worse than before? They just don’t get it. I will never buy another HP product and believe me, I have spent over $25,000 with them over the years.
It seems HP have once again forced a firmware upgrade that is disabling printing with non-HP cartridges. Are they now in some form of “contempt of court” for re-offending?
Is there any recourse for us, short of creating another class action?
Seems extraordinary that they can pay out $1.5M then carry on as if it never happened. I guess it shows how much money they are making by over-pricing their cartridge products.

Hi Jeremy, I believe that HP is in “contempt of court” also. And it most definitely involves what they have led consumers to believe about being able to use Non-HP Printer Ink Cartridges in HP Printers. HP is still lying about this.
HP has disabled my HP Officejet 4620 Series from printing anything that has the need for black ink, due to my installing a non-hp black ink cartridge into it. That means that anything in text form does not get printed. I only get blank pages. Yet, when I ask what my “ink cartridge levels” are, it shows that the black ink cartridge that was full when I installed it, has now gotten much lower. But the printer refuses to print out anything that calls for the use of black ink.
I feel as though HP is still lying about the use of non-hp ink cartridges in their printers. They may have put an end to using a particular Firmware but they haven’t put an end to their lies.
To be honest, I feel that the $1.5 million settlement was like a slap on the hand WITH a nylon to them because they obviously haven’t learned a lesson from it. I hope something can be done so that this doesn’t continue on as it currently STILL is.

I agree Jeremy. Hard to believe that HP just doesn’t get it. Look, I would pay a little more for a printer just as long as I can use whatever ink I want. To hold a printer hostage is criminal.
That’s because $1.5 is nothing but lunch money for HP to continue with their everyday scam routine, that will gain them billions in comparison. So it pays off for them to settle and continue their illegal actions.
My Deskjet 2540 is having the same problems now. It started several months ago.

The price of the ink cartridges is highly inflated and a total RIP off. I will never reinvest my funds in a company whose main objective or goal is to take advantage of its consumers. MONEY does not grow on trees.

I have used remanufactured ink cartridges over the years and have run into this problem over and over again with “printer updates made by HP. As a small business owner I have lost much time which equals money to get a working printer. I would rather have printable cartridges at reasonable prices. A combo pack costs $119 at office Max. A remanufactured combo $50-$60. If HP were smart they would match the Remanufactured pricing and get all the business. Now I will NEVER buy another HP product again. I had all HP in my home and business, but no more. Greedy bunch of AH”s
They needed to add the 5610 as well. Had the same problem after purchasing ink from Amazon. Ended up just chucking it,

I called the number and got a message that either no one available or called outside business hours. I’m assuming no one received anything. Just not right at all. Just guilty of buying the cheap ink because theirs is over priced and don’t last long. Now stuck with nothing but error codes and expensive piece of weighted crap.

No payment as of 10/7/19. Payments should have been sent by July 2019. It’s going on 6 months after the settlement was granted. Start calling the administrator at 1-877-861-1101 to find out what the heck is going on.

Yes, I have been calling since May 2019, mainly to confirm personal information and
proof of documentation.
The person answering the phone is an unknowledgeable virtual assistant or 3rd party company. They don’t have answers and read from a script like a robot. The process is slow and expect to jump through hoops.
They will need to initiate an inquiry for anything/everything and “submit a request for follow up from their team”.
They claim they’ll call you back within 3 days with an answer or confirmation. I received 1 call back out of the 5 times I’ve called.

I am so infuriated. HP is at it again!! Printer less than a year old, will not accept refilled cartridges!! An automated update in April 2019 locked the firmware so the printer can no longer accept refilled cartridges. HP said there is nothing they could do!!! They offered to send me a new printer, the printer they sent was obviously broken, they sent me ‘free’ cartridges, that they then told me to return to them!!! Then they told me to mail my printer back to them and they would give me a gift card (not even enough to purchase a new printer)… leaving me without a printer for a while. I have spent hundreds of dollars on brand new cartridges, every time the printer ‘primes’ the cartridges which seem to cause the cartridges to deplete!! And I have spent numerous hours trying to fix the issue, and having to run to a printing store to print!!! Are any more class action suits coming against this company who obviously do not care about their customers or that their business model is obviously flawed?

I purchased an OfficeJet 6960 last year. I bought one set of back up ink on the day I purchased the printer. I subscribed to the HP insta-ink, but I used the backup before receiving any of the insta-ink, I received replacements for the CMY colors, but the insta-ink website will not recognize the HP black ink that I bought at the store.
In the mean time, Ive got documents I wish to print, but without the black ink, it is futile. I could go to best buy and by some more HP ink, but that cartridge won’t be recognized either, because it is not insta-ink.
I call customer service and the number they gave me… a non 800 long distance number cannot be reached at the moment.
The chat help desk is closed on weekends, although I did reach them on Monday , they said my ink was in the mail. It has as of yet gotten here.
In the mean time my credit card has been getting charged and I feel HP has duped its customers into a faulty service.

I thought it was something I did. I purchased new ink cartridges and almost purchased a new printer until I ran across the class action lawsuit. Thank God for Top Class Actions.

hp 8620. time and aggravation with their scam . Aftermarket and setup cartridges rejected. so many phony messages on the machine. either this is fixed or never buy hp again.
We have purchased 3 of the HP 8710 – (is there a lawsuit started for this?) continually receive an error message that ink cartridges are not installed correctly however if I put in an HP cartridge – no error message. So frustrated and am ready to throw them all away and purchase another brand.
Why isnt photosmart c6280 not included ? 1st they tell you ink may csuse damage, then later says ink cartridge failure, and why ony 150 million settlement considering probably 10x more recieved from forced hp ink purchases, settlement notice recieved after filing deadline, not fair.. why not publicly announce lawsuit, i want in, been fighting HP for years about this, also force them to allow stand alone printing without internet connection option.

I returned a printer last year to Bestbuys that gave me errors when I tried store bought ink after using the HP product. I don’ believe it’s any of the printers on the list. I gave up and went back to HP. I feel like I have to accept their product because I have another HP Printer that they essentially control. I tried to end their service and I was told they would not allow me to continue to use any of the ink I purchased under HP. my printer is an HP Jet 3830.

I have an office jet 3860 that I got FREE ink with originally and because I signed up with their ink service then I cancelled that ink was no longer able to be used as free ink anymore. What kind of bs is that? To top it off it would not allow me to only put black ink without the colored ink to be changed as well. What about if it rejected a brand new HP printer…. mine did and completely would not do anything, even let me close the cartridge department without a ridiculous beeping telling me I had a non-HP printer….
I know a couple people that had this problem as well. SPent money to buy HP and then the HP said it wasn’t a valid HP cartidge. That should be a lawsuit….

As a retired HP employee I used nothing but HP printers and now am on my 5th printer Four of them were ENVY class printers and every one encountered this problem. I have already changed out my HP printer for an Epson printer. I will not buy another HP printer again. I agree with previous notes as to why the ENVY class is not included. The personal time trying to deal with this problem, the cost of many unuseable ink cartridges is significant. HP once had the top reputation for printer systems, I hope they made enough money on this fiasco since they are in my opinion at the bottom of the list .

I have an Officejet J5780 All in One printer, fax, scan machine and have been following this litigation. I’ve had this problem for the past couple of years or more with this same issue. I know I have this infectious firmware implanted because I found a bypass code that someone who used to work for HP put online. It overrides the error code and allows you to print, but it’s a pain in the ass fix because every single time you want to print, you need to put in the override code. If this lawsuit won’t cover this model or other models not listed above, then it is it possible to open up a new lawsuit to net protect all the other victims of this illegal action that will not get any relief from this one ? At very least, is there a chance to bring this issue up at the next hearing and try to piggy back any and all affected models on this one ? Thank you so much for your anticipated response.

I HAVE AN HP 5660 ENVY PRINTER THAT GIVES ME THE SAME MESSAGE WHEN I PURCHASE NON-HP INK CARTRIDGES. I HAD A PREVIOUS HP PRINTER THAT DID THE SAME BUT I DO NOT HAVE THE INFORMATION ON THAT ONE. WOULD MY 5660 ENVY PRINTER QUALIFY?

We own two HP printers — HP Officejet Pro 8600 and HP Officejet Pro 8610. The 8610 is listed in the “class of printers”. Since the 8600 uses the same cartridge I am asking if the 8600 also qualifies as a member of the “class of printers”?
