Honda class action lawsuitA federal class action lawsuit has been filed against Honda claiming its 2003-2007 Accords and Civics have defective paint that delaminates, causing the vehicles to appear faded or to have peeling paint.

The Honda Civic/Accord paint class action lawsuit was filed by two Plaintiffs, including a New York resident who alleges portions of her 2003 Honda Accord began exhibiting “areas and splotches of deterioration and eventually grey or white areas where the vehicle’s original paint had delaminated. Over time, the paint delamination has increased in severity and extent, covering several of the vehicle’s body panels.” When the Plaintiff brought her car to a Honda dealership to repair the paint delamination, Honda denied her request because it was beyond the 3 year/36,000 mile warranty.

“In modern vehicles, automobile paint is routinely expected to last the lifetime of the vehicle, such that, absent an accident, a vehicles owner reasonably would not expect to have to spend thousands of dollars to have his or her vehicles stripped and repainted during ownership of the car,” the class action lawsuit says. “Honda, however, has manufactured vehicles with a defective paint or paint application, that leaves vehicle owners with a vehicle of unacceptable appearance. In addition, the delamination of the paint from the vehicle’s body panels, exposing the vehicle to enhanced erosion.”

The Honda paint class action lawsuit is brought on behalf of all California and New York owners of a model year 2003-2007 Honda vehicles. It is seeking actual damages and losses sustained by Class Members and other relief for breach of express warranty, breach of implied warranty of merchantability, and violation of California’s unfair competition law.

    #4 Brian is not entirely correct. Most waxes and sealants DO NOT have any UV protection in them. The clear coat is supposed to have UV protection in it, that’s why most modern cars (except Honda and Toyota who don’t clear coat solid white paints) use a base coat/clear coat paint system. The clear coat has UV protection in it to keep the color coat underneath from fading. That doesn’t mean you shouldn’t wax your car by any means, the wax helps protect from acid rain, bird bomb etchings and other environmental issues. But a modern base coat/clear coat paint job shouldn’t start to fade or oxidized in just a few years even if not waxed regularly.

    I’ve been lucky with my 2004 Accord I guess, or maybe the desert mist metallic paint isn’t as prone to clear coat failure as the blue, black or night hawk pearl black.

    my friend’s 2008 Honda civic lx has the same issue on the rear section of the roof, so apparently has not fixed the issue. What is the current status of this case and can the later models be included?

    i hvae a 08 si paint succks!!!!! like all others roof is bad i would like to join the law suit honda gave me the run around like others on this page they know this is a problem and need to fix it i also bought my car new

    I just got off the phone with Honda Corp and was denied any assistace with this paint defect. I just bought a 2006 red Honda Civic SI from Folsom Lake Honda 14 months ago and now the paint on the hood, roof and one of the rear edge near the passenger side window is peeling off and oxidizing away. I also own a 2001 dark blue Jeep Grand Cherokee and the paint is excellent. This is very unacceptable and would like Honda to step up and admit this is definitely a manufacturer defect. I have always trusted Honda and love their cars. However, my recent experience with Honda support has changed my outlook. I hope this case will voice our complaint and find a resolution to this problem.

    I have a black 2005 Honda Accord and the paint has been coming off my car for over a year. It is really embarrassing to drive my car. I have complained to Rick Case Honda in Weston Florida for the last year. When I first called the person in the collision department asked is your car black or blue. they know their paint is defective. Finally the collision manager told me they would take pictures and send them to the regional manager for approval to paint. The regional manager who is a ghost to me told them that my car was out of warranty now and they wouldn’t paint it. I called the Honda corporate customer service and they said they can’t help me only the regional manager in my area can help, again he is a ghost to me and thru the collision manager the regional manager won’t approve to paint.

    My 2005 Blue Honda Civics paint has been peeling off in chunks for well over a year. There are areas on the hood, trunk, roof and doors that are continually peeling off. I probably could take all the paint off myself by peeling all the loose ends. I brought my car to the Honda dealership and met up with the regional manager last year. The guy had the nerve to tell me that it was probably my fault and that it could be from the environment. I live in San Francisco, There is no extreme climate changes in my area. I want in on the class action suit. What do I need to do?

    I own a NH Black ’08 Si Sedan, I noticed a slight fading on the rear section of my roof. This spot quickly turned to a white splotch, and then I noticed the same thing happening to the front of my roof. A real embarrassment. I work for Honda. I take a lot of pride in my car and what I do, so I hate having to explain why the paint on my supposedly “high-quality” car looks the way it does. I live in Ohio, and have owned the car since it came off the assembly line in Alliston ON. How do I join this lawsuit?
