A class action investigation is now looking into the call recording practices at appliance company Fisher & Paykel and several other companies following allegations of possible illegal call recording.
California Call Recording Laws
California laws regarding illegal call recording are stricter than the phone recording laws at the federal level. Several California businesses, including Fisher & Paykel, are currently being investigated for possible violations of California recording laws.
California law generally prohibits the recording of phone calls without first clearly obtaining the consent of all parties taking part in the call. A clear violation of that law would be if a company failed to give adequate warning that a call was being recorded.
The call recording regulations of California do not just apply only residents of the state itself. In fact, these laws protect anybody who called or were called by someone else while in the state of California. However, this particular California phone recording class action investigation specifically applies to California residents.
If you have called or been called by Fisher & Paykel or another company in California and believe the company may have engaged in illegal call recording, you may be entitled to compensation.
What Might a Call Recording Warning Sound Like?
Many companies make a habit of recording phone calls with consumers—this is nothing out of the ordinary. This is often done to add to their records, or to evaluate employee performance.
You may recognize this as one of the most common phone recording warnings: “This call is being monitored for quality assurance,” or something very similar.
You may have noticed that, in many cases, these warnings are automated. So how are you expected to opt in or out of being recorded without being able to respond “yes” or “no”? Verbal acceptance is not actually necessary in these cases — simply staying on the line constitutes acceptance of the recording, and hanging up rather effectively indicates your refusal.
Illegal Call Recording Investigation
If you do not hear a warning but believe a call was recorded, the company may have violated California phone recording laws. The appliance manufacturer Fisher & Paykel is one of several companies currently under investigation for the possible use of illegal call recording practices with customers.
Other companies under investigation include:
- American Airlines
- AMF Bowling
- British Airways
- Czech Airlines
- Malaysia Airlines
- Miele

Lawsuits over illegal call recording have targeted some major companies, some of which have ended in multi-million dollar settlements. Illegal call recording in California by Fisher & Paykel or other businesses violates consumers’ call recording rights.
