Gentry Homes hurricane straps class action lawsuit

Gentry Homes Ltd. is currently facing a class action lawsuit alleging the hurricane straps installed in certain Gentry homes are defective and do not comply with the relevant codes. If you own a residential structure with hurricane straps embedded in the foundations in the Ewa by Gentry housing development in Honolulu, your rights may be affected by the hurricane straps class action lawsuit.

The hurricane straps class action lawsuit seeks to hold Gentry Homes liable for the allegedly defective hurricane straps. The plaintiff wants the affected homeowners to be paid for the current and future damages to their homes caused by the allegedly defective hurricane straps.

According to the hurricane straps class action lawsuit, Gentry Homes installed hurricane straps manufactured by Simpson Strong-Tie Company Inc. and Simpson Manufacturing Co. Inc. that “have or will become corroded and have lost or will lose their ability to provide structural support for the Plaintiffs’ homes as required by the City and County of Honolulu.”

As a result of the alleged hurricane strap defect, “Plaintiffs’ homes cannot resist uplifting, racking, and other forces which may destroy the homes during high winds because they are not secured to their foundations,” the hurricane straps class action lawsuit alleges. “If wind gusts rip even one house frame from its foundation, flying debris from that home could strike people and property throughout the community and in surrounding areas.”

The plaintiffs claim that the defendants knew or should have known that it was necessary to install high-wind protection measures that would not corrode due to the conditions in Hawaii. According to the Gentry Homes class action lawsuit, anyone who owns a residential structure with the allegedly defective hurricane straps will need to install code-compliant wind protection for the home—a process that will require the removal of the allegedly defective hurricane straps and repair of the home’s foundation.

Gentry Homes denies the allegations set forth in the hurricane strap defect class action lawsuit. The case will go to arbitration, but a date has not yet been set.

Class Members who wish to exclude themselves from the hurricane straps class action lawsuit must do so no later than Jan. 14, 2016.

Class Members of the Gentry hurricane straps class action lawsuit include: “All individuals and entities that own residential structures constructed with hurricane straps embedded in the foundations substantially completed on or after July 20, 2001 in the housing development known as Ewa by Gentry, located in the City and County of Honolulu, Island of Oahu, State of Hawaii, and all homeowners associations consist of such individual and entity homeowners.”
