General Motors Class Action Lawsuit Overview:
- Who: General Motors must face a class action lawsuit alleging it concealed an issue with its starters.
- Why: U.S. Circuit Judge Stephanos Bibas trimmed some of the drivers’ claims against the company but ruled it must face the majority of the consumer protection claims related to the alleged defect.
- Where: The class action lawsuit was filed in Delaware federal court.
General Motors must face a class action lawsuit alleging that it deceived Chevrolet Camaro owners, although the car owners’ lawsuit has been trimmed due to late filings and out-of-warranty repairs.
U.S. Circuit Judge Stephanos Bibas ruled that General Motors must face the majority of the drivers’ consumer protection claims related to alleged concealed defects in parts installed in recent Chevrolet Camaro models, denying the automakers bid to dismiss the lawsuit.
GM did successfully argue that some of the Camaro buyers’ warranties expired by the time they sought repairs, and it managed to avoid claims brought under the Magnuson-Moss Warranty Act, as well as the allegations of unjust enrichment claims from representing a nationwide class. But most claims lived “to fight another day,” Bibas said.
Drivers Claim Defective Heat Shields Make Camaros Unsafe
The drivers say in their class action lawsuit that every Camaro since model year 2010 has a defective heat shield that makes their cars unsafe, causing them to start slowly, not start at all or stall mid-drive.
General Motors argued that it had no duty to disclose the alleged starter defect, and it couldn’t be found responsible for a “deceptive omission” because the drivers could only allege it had stayed silent on the issue rather than covering it up.
Bibas, however, said, “each state’s law says otherwise.”
“GM does not show that any other class’s consumer-protection and warranty claims fail the predominance requirement. So I will deny those motions to strike,” Bibas wrote in his decision.
Meanwhile, General Motors is facing a separate class action lawsuit that alleges the company refuses to fix a defect in its Chevys which forces drivers to “try to trick their vehicles” into recognizing they are in “park.”
Lead plaintiff Ben Emmrich says GM has manufactured and sold hundreds of thousands of Chevrolet Malibu, Chevrolet Volt, Chevrolet Traverse and Chevrolet Blazer vehicles from approximately mid-2015 to the present that have a major defect.

I have a 2014 Silverado 1500 LT . 107,000 miles. Always serviced , no warning of problems. Got in it to leave my hotel and 1 block from hotel big miss and check engine light flashing. Stopped immediately and towed to GM Agency. They told me it could be bad camshaft, lifters , or possibly bad head. Recommended fixes 6,000 dollars for the repair or 12,000 dollar new GM motor. The dealership said that my problem is common with number of miles I have. This sounds to me like a defect by GM. May I also add my son had a 2007 Tahoe that had same problem with almost same mileage. Repair cost 3,700 dollars in 2012. Sounds like there is a defective motor.
2017 Silverado Z71 …… Blown engine due to lifters (and just out of warranty) Touch screen would short and not connect or turn on the radio. The final straw was after paying over $12 000 (yes 12 thousand) in two years for repairs at the dealership the transmission die at a red light with no warning.
I have paperwork on everything ….. Is there anything I can do?
I forgot to mention …. I purchased it brand new and my only towing was a bass tracker boat. So these issues were not from me being hard on the vehicle
My son purchased a 2015 Chevrolet Silverado 1500 LT with a 5.3 Liter engine in May 0f 2022 witch now has 106751 total miles, of which my son put less than 1000 miles on it and since the purchase, and #7 lifter has failed. He is faced with his truck payments for $25,000.00 Truck that the dealership to date has not indicated they will try to help him out, and GM has no recall as of today on the lifter problem. So we are looking to get on a Class Action Lawsuit. Will be attemping to help him do that.
We spent $2660 on repair for 2017 ChevybSilverado lifter failure. Now the transmission has a shudder shifting into gears, and the power steering goes out when turning a corner.
I have a 2021 Malibu and put my car into park, my daughter and I got out of the Vehicle went inside. I came back out the car was rolling backwards. GM ESIS department denies my claim. I got caught under the car trying to stop it. Everyone please be careful

I have 2010 GMC TERRAIN SLE 2.4L and I swear I have had every issue in order I was 2weeks shy of my warranty expiring they tore my engine down to nothing to tell me it wouldn’t be covered the mechanics couldn’t believe seeing as 2days prior they filled all fluids and when I same problem “loss of engine power” persisted they checked my fluids “oil” and it was empty! EMPTY, 2 DAYS LATER! I was forced to pay $3500 to get it back cuz I still owe $4400 on it only for the same thing to happen less than 1 yr later now the dealership will not return my call to maintain their 1yr warranty! I called into work I’m a single parent with no transportation or extra repair money for an ONGOING ISSUE WITH GM MOTORS!! PLZ HELP

I had a 2015 terrain and it completely stop with no warning, So my mother went out and purchase a 2014 traverse and soon i pulled off the Dave Sinclair lot here in St.Louis Mo my SUV you start shaking on the highway i called back to the dealership and told the sell agent. A few days later my electrical system started messing up. my head lights the airbag light came on then stablink bar and shut engine came on.
My 2016 Chevy SS CAMARO was in the dealership well over 10 times. From shaking at 7000 miles which was metal in transmission no fix just flushed it to not starting to windshield wiper motor at 12000 MI replaced to not able to shift…shifting locked out by defective computer issue. To no starting caused by computer and then lifters in engine defective. I had no choice but to get rid of it in 2019 at only 23,000 miles. I spent more time in dealership driving a rental than I did my new SS CAMARO.
