A new class action lawsuit alleges Post Consumer Brands falsely advertises its Fruity Pebbles cereal as “Family Size” when it contains fewer servings than advertised.
Plaintiff Erin Sweeney filed the class action complaint against Post on Nov. 5 in New York federal court, alleging violations of state and federal consumer laws.
The lawsuit says Post’s Fruity Pebbles cereal box prominently displays a “Family Size” label, suggesting it contains more servings than a standard box. However, Sweeney claims independent testing revealed the cereal contains significantly fewer servings than advertised.
The lawsuit alleges that Post’s Fruity Pebbles cereal box claims to contain 15 servings, but testing showed it actually contains only about 12.2 servings. This discrepancy misleads consumers who believe they are getting more cereal for their money, the class action lawsuit claims.
Fruity Pebbles cereal contains more calories than indicated, class action says
In addition to the serving size issue, the lawsuit also alleges that the nutritional information on the Fruity Pebbles box is inaccurate. Sweeney claims the cereal contains more calories, sodium and sugar per serving than the label indicates.
Sweeney says she and other consumers paid a premium for the Fruity Pebbles cereal based on the misleading “Family Size” label and nutritional information.
As a result, the lawsuit is seeking to represent anyone who purchased Fruity Pebbles cereal in New York in the past four years.
Sweeney is suing for violations of New York consumer laws, breach of warranty and unjust enrichment. It seeks certification of the class action, damages, fees, costs and a jury trial.
Earlier this year, a consumer hit Post Consumer Brands with a separate class action lawsuit alleging the company falsely advertised its Rachael Ray Nutrish pet food products as preservative-free.
