ASBESTOSA former teacher filed a lawsuit against a Kentucky County School District alleging exposure to asbestos fibers while working in schools led him to develop mesothelioma.

Plaintiff Roger H. says he was diagnosed about a year ago with malignant mesothelioma, a fatal form of cancer caused by asbestos exposure.

Once he recovered from the shock of the terminal diagnosis, Roger says he conducted extensive research to find the cause. He determined it was from exposure to asbestos while teaching.

Roger taught history at Old Letcher High School between 1976 and 2003. He says former colleagues told him the school had a considerable amount of asbestos.

Asbestos becomes dangerous when disturbed by activities like repairing, removal, or sanding. It is made up of microscopic fibers that are highly friable, meaning it breaks apart and easily becomes airborne.

People who spend a lot of time in older school buildings under renovation or repair, can inhale large amounts of these tiny fibers, some of which may get caught in the protective lining of the lungs, abdomen or heart. These fibers can eventually cause scarring, inflammation, and cellular changes — all of which can lead to mesothelioma.

According to the Environmental Protection Agency, however, asbestos doesn’t automatically pose a health risk. The mineral isn’t dangerous when it’s properly installed and contained within other materials.

However, the EPA attempted to ban asbestos with the Asbestos Ban and Phaseout Act of 1989, but the Fifth Circuit Court of Appeals overturned it in 1991. Nevertheless, most companies removed asbestos from their products in the 1980s.

Asbestos Lung Cancer Lawsuits

Mesothelioma is an aggressive form of cancer that predominantly affects the lining of the lungs (pleural mesothelioma) or abdomen (peritoneal mesothelioma). Most cases of the disease are caused by exposure to asbestos. Symptoms of mesothelioma don’t appear until 10 to 50 years after a person was exposed to asbestos.

Anyone who developed an asbestos-related disease because of exposure could be eligible to file a lawsuit against the manufacturers of asbestos products and those that failed to protect or warn against asbestos exposure.
