
A Florida resident was allegedly wrongfully denied long-term disability benefits by Unum Life Insurance Company. Unum has been faced with countless lawsuits claiming they were guilty of bad faith insurance practices and has been accused of systematically denying disability claims.
Plaintiff Olga O. was provided Unum disability benefits through her employer, Starwood Resorts. Her health plan entitled her to certain disability benefits should she be unable to properly perform all of her tasks at work due to a disability.
In Olga’s case, “Unum denied and/or terminated [her] claim finding that she was not disabled under the terns of [her disability insurance plan],” according to the disability insurance lawsuit. Unum last rejected Olga’s claim in late December 2014.
The Unum lawsuit states that the plaintiff “was and is disabled as defined by the Plan at all times material hereto.” When Olga rightfully filed for long-term disability benefits, Unum allegedly practiced bad faith insurance and wrongfully denied her claims.
Now, Olga is faced with large medical, legal, and other bills due to Unum’s wrongful denial. She is one of countless individuals who is seeking monetary compensation for long-term disability benefits.
Unum Bad Faith Insurance Lawsuits
Unum is one of the largest disability insurance providers in the country and has been accused of having a conflict of interest.
The large disability benefits company is both responsible for determining if a client is due long-term disability benefits and for paying for those benefits. In-house physicians have testified that they were encouraged to find a policyholder not disabled so that Unum would not have to provide the benefits the patients might deserve. Unum allegedly has brought in external medical professionals that claimed plaintiffs were in fact disabled according to the definition set forth by Unum. Yet Unum has rejected hundreds if not thousands of claims, causing many to file Unum lawsuits.
An Unum class action lawsuit investigation has been launched looking into these allegations for a large number of people who claim that they were wrongfully denied long-term disability benefits or terminated mid-plan.
This Unum Lawsuit is Case No. 8:15-cv-00217, in the U.S. District Court of the Middle District of Florida, Tampa Division.
