A wrongful death lawsuit has been filed by the family of a Maumee, Ohio man, claiming the owners and operators of a pontoon boat the their son was aboard prior to his death by drowning should be held accountable.
According to news reports, Mustafa N. was 19 years old at the time of his death on Aug. 14, 2014, when he drowned in a private lake in Springfield Township.
Mustafa’s family recently filed a wrongful death lawsuit in Lucas County Common Pleas Court against Donald and Kathryn A., the owners of the lake front home that housed their pontoon boat from which Mustafa drowned. The plaintiffs also named Ryan B., Donald and Kathryn’s grandson, as a defendant in this wrongful death lawsuit for his alleged involvement in their son’s death.
Ryan was allegedly operating the pontoon boat while drunk on the August day Mustafa died. His grandparents allegedly knew Ryan was under the influence of alcohol, despite not being 21 years old, and still allowed him to operate the boat on the private lake.
According to the wrongful death lawsuit, safety equipment was not readily available on the pontoon boat the day Mustafa drowned. Furthermore, the complaint alleges Ryan refused to help Mustafa when he fell in the water and was flailing his arms about to keep afloat.
The wrongful death lawsuits claims, “Ryan failed to throw a life ring to Mustafa as he struggled, perhaps because it was stowed, perhaps because he did not know what to do, perhaps because he was under the influence.”
Mustafa’s family is seeking more than $25,000 in damages.
