wrongful death lawsuitA wrongful death lawsuit was filed against an insurance provider for allegedly causing a mother of two to die prematurely. The wrongful death lawsuit claimed that Health Net of California wrongfully denied the decedent coverage for her cancer treatment, which led to her wrongful death.

The wrongful death lawsuit was filed by decedent Alicin B.’s two daughters Tamara A. and Natasha B. Alicin was diagnosed with stage 3 colon cancer in the fall of 2012. Following surgery, the cancer continued to grow and progressed to stage 4 as of Aug. 2013. According to the Health Net wrongful death lawsuit, the decedent began chemotherapy in October and began to improve.

In the summer of 2014, however, Alicin’s health insurance plan was transferred from California’s Department of Health Care Services to Health Net. Health Net allegedly immediately denied Alicin coverage for her chemotherapy, deeming the treatments unnecessary. Additionally, they claimed Alicin’s treating physician was not in their provider network.

Both the treating physician and the plaintiffs appealed to Health Net, asking for the decedent to have her insurance coverage reinstated. Health Net denied their request.

Alicin died from colon cancer in Oct. 2015 after spending a month in hospice care. The wrongful death lawsuit claims that the plaintiffs of this case “will always be haunted by the thought that their mother could have lived longer had Health Net not interrupted her cancer treatments.”

Health Net may be held liable for all of the damages listed in the wrongful death lawsuit. The Health Net wrongful death lawsuit alleges the health insurance provider committed elder abuse, negligence, caused emotional stress, and wrongful death.
