A woman scalded by hot chili from her allegedly exploding Cuisinart pressure cooker has lodged a class action lawsuit against the company.
Plaintiff Shelly Wicklund says that during regular and recommended operation of the Cuisinart pressure cooker the device generates high levels of heat and steam.
According to the Cuisinart class action lawsuit, the owner’s manual for the Cuisinart pressure cooker explains that only when the lid is locked tightly will the device begin to reach high temperatures with heat and steam.
The plaintiff claims, however, that this is not the case, and that users could be exposed to severe burns when using the device as outlined in the product manual.
The Cuisinart pressure cooker class action lawsuit alleges that the primary defect with the Cuisinart pressure cooker is that the consumer can indeed take the lid off during the cooking process, meaning that the scalding hot contents inside can cause burns and severe pain for anyone standing nearby. Those pressurized contents can explode over an entire kitchen and burn anyone close, Wicklund claims.
The Cuisinart class action lawsuit states that the defective lid locking mechanism gives users a false sense of safety since it does appear to lock and since the product manual claims that this is a primary feature that prevents injuries.
However, Wicklund says the lid can explosively separate from the rest of the Cuisinart pressure cooker, causing the hot contents to hit anyone in the vicinity.
The way that the pressure cooker operates means that the contents inside reaching extremely high temperatures are capable of burning consumers if the lid was to open prior to the completion of the cooking process, the plaintiff states.
The Cuisinart Model Number CPC-600 and all similarly-designed Cuisinart Electric Pressure Cooker models are defective, according to the Cuisinart pressure cooker class action lawsuit.
The Cusiniart defective pressure cooker class action alleges that the company knows about the defect and fails to disclose it or should have discovered the defect during the testing process, and that consumers deserve to know about such a dangerous defect.
The plaintiff says that despite the device manual information claiming that she would not be able to open the locked lid after beginning the cooking process, that she removed the lid and suffered severe injuries when the scalding hot contents inside exploded out onto her.
She claims that she and at least 100 other Class Members could be entitled to compensation as a result of the defect that was never disclosed to them.
Wicklund contends that she would not have purchased the Cuisinart pressure cooker if she had known about the possibility of the exploding lid and the resulting burn injuries.
The Cuisinart class action lawsuit says that even the risk of the lid opening during the cooking process puts all users and owners of the Cuisinart pressure cooker at risk for injuries.
Other potential Class Members include a nationwide group and a South Dakota Class of those who purchased the Cuisinart pressure cooker models listed above.
The Cuisinart class action lawsuit seeks restitution in the form of payment to putative Class Members and injunctive relief requiring Cuisinart to issue corrective actions.
