Have you ever owned or leased a 2005 or 2006 Honda Element whose windshield cracked while the car was covered under the standard manufacturer’s warranty? If so, you could get benefits from a proposed class action settlement. A class action lawsuit alleges Honda knowingly sold 2005 and 2006 model year Honda Elements without disclosing that these vehicles have a design or manufacturing defect that causes the windshields to crack without any impact or from light contact with ordinary road debris that would not normally cause them to crack. If the settlement is approved, you can receive a reimbursement of 100% of your out-of-pocket costs for parts and labor for the first cracked OEM windshield that you paid to fix or replace during the standard warranty period. Those who paid for second and third windshield replacements can receive reimbursements of 70% and 50% of their out-of-pocket costs. An “OEM windshield” means a windshield that was either originally installed when your vehicle was purchased new or a replacement windshield that is a Honda genuine part (it will have a Honda logo on it). The deadline to submit a claim is September 1, 2010 or 90 days after you paid to replace an OEM windshield during your class vehicle’s standard warranty period — whichever is later. You will have to submit either a receipt, work order, repair order, cancelled check, and/or a credit card receipt/statement along with your claim form.
