A New York husband and wife recently filed a slip and fall lawsuit against plumbing company Schmidt’s Wholesale.
The plaintiff, Yecheskel P., alleges that while he was at the company’s New York location to purchase supplies, he slipped and fell in the driveway/loading area, leading to serious and permanent injuries.
According to the slip and fall lawsuit, Yecheskel’s injury was caused by negligence and carelessness by Schmidt’s Wholesale, which he alleges should be held responsible for his injuries. Indeed, he claims, the company failed to clear snow and ice in the area, and further failed to warn him about the risk, despite telling him to go to their New York store to pick up supplies.
The plaintiff’s injuries include a fracture of his right leg which caused pain and suffering and even required surgery and physical therapy treatment. These injuries, his lawsuit claims, have caused the plaintiff to be unable to perform his regular duties, and will continue to do so into the future. Yecheskel’s wife Esther also filed one count of loss of consortium.
The slip and fall lawsuit was filed on March 20, 2018, in the U.S. District Court for the Southern District of New York.
Filing a Personal Injury Lawsuit
If you or someone you love has suffered from a personal injury like a slip and fall incident, you may be able to file a lawsuit.
Slip and fall injuries like Yecheskel’s can be devastating, but those who have suffered from injuries like this may find that filing a personal injury lawsuit can help them with compensation. Personal injury claims, like this slip and fall lawsuit, rest on the concept of negligence—that is, the idea that another party’s negligence or carelessness led directly to your injuries.
Negligence is legally defined as “the failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”
A slip and fall lawsuit like Yecheskel’s is a common form of personal injury litigation. Other personal injury lawsuits include birth injuries, work injuries, dog bites, medical malpractice, and car accidents, among many others.
If you have a personal injury claim and want to seek compensation, you may be able to file a lawsuit. A personal injury lawsuit can help compensate for medical bills, lost income, physical pain and suffering, loss of enjoyment of life, disability or disfigurement, property damage, emotional distress, and/or wrongful death. Filing a personal injury lawsuit cannot take away the pain and suffering caused by injuries, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Slip and Fall Lawsuit is Case No. 1:18-cv-04155-RJS, filed in U.S. District Court for the Southern District of New York.
