Attorneys trying to help American corn farmers decide whether to file a Syngenta corn lawsuit to recover from China’s 2013 devastating GMO corn ban, claim there’s no downside to pursuing legal action.

According to multiple corn attorneys, there’s no up-front fees for farmers to file GMO corn lawsuitsagainst Syngenta, and plaintiffs would receive 60 percent of the lawsuit settlement or jury award.

In the event that there is no settlement or award for the Syngenta lawsuits, attorneys remind potential plaintiffs that there would be no fees owed to the legal team that helped pursue their claim.

U.S. attorneys reaching out to farmers throughout the “corn belt” of the nation say Syngenta lawsuits are worth filing because had the GMO corn seed manufacturer simply waited until having a formal Chinese approval of the genetic modified corn product, farmers could have avoided the collective $3 billion dollar loss.

GMO MIR162 Corn Seed Overview

Syngenta started marketing the GMO corn seed Viptera to U.S. farmers in 2010. The genetically modified corn seed was promoted as having a better defense system against common corn pests including earworms and black cutworms.

Corn farmers throughout the nation began to buy the GMO corn seed after assurances from Syngenta that China, the third largest corn importer, would approve the use of the MIR162 corn seed within “a matter of a couple of days.”

However, China did not approve the GMO corn seed nor did it allow any corn to be imported that had traces of MIR162. This essentially blocked all U.S. corn imports into China.

After the China ban on U.S. corn, sales around the world dropped by 85 percent.

U.S. Corn Industry Explained

According to numerous Syngenta corn lawsuits, the U.S. depends on a commodity based corn market which means that farmers harvest, consolidate and then ship their product to regional distribution centers where the corn is then exported to foreign countries.

Although the Viptera corn seed was only planted on about three percent of U.S. acres, plaintiffs allege that Syngenta urged corn farmers to plant the GMO seeds side-by-side which led to commingling.

Farmers further claim that they had no way of knowing that the GMO corn would need to be separated in elevators from non-GMO corn, so essentially even farmers who chose not to use the Viptera corn seed had a product that was contaminated.

Syngenta Corn Lawsuits

More than 10,000 Syngenta corn lawsuits have been filed by farmers, corn exporters and corn brokers. In general, farmers claim Syngenta was reckless to promote the sale of a product that was not approved of by one of the largest corn importers.
