Class Action Settlement Deadlines Loom for Discover Card Product & Blue Sky Soda Lawsuits

class action settlementThe deadlines to file a claim for the Discover Card Product class action settlement and Blue Sky Soda class action settlement are quickly approaching. If you haven’t filed a claim yet, we suggest you do now before it’s too late. Here’s a little background on the cases to get you started.

Discover Card Product Class Action Lawsuit Settlement

The Discover card settlement will resolve a class action lawsuit, entitled In Re: Discover Payment Protection Plan Marketing and Sales Practices Litigation, that alleges Discover duped its customers into signing up for the fee-based products: Discover Payment Protection (formerly known as Discover AccountGuard), Identity Theft Protection (formerly known as Profile Protect), Wallet Protection (formerly known as The Register), and Credit Score Tracker.

Class Members of the Discover card product class action settlement include all persons in the United States who were enrolled in or billed for Discover Payment Protection, AccountGuard, Identity Theft Protection, Profile Protect, Wallet Protection, The Register and/or Credit Score Tracker between January 21, 2004 and November 9, 2011.

Class Members have until June 6, 2012 to file a claim to receive a cash payment of up to $30.

Blue Sky Soda Class Action Lawsuit Settlement

The Blue Sky Soda settlement will resolve a class action lawsuit, entitled Chavez v. Blue Sky Natural Beverage Company, that alleges the company misled consumers into believing Blue Sky sodas are made in Santa Fe, NM, through references on its cans, on its website and in its advertising and promotional materials. The class action lawsuit alleges these activities were false and misleading and violated state and federal requirements for the labeling of beverages.

Class Members of the Blue Sky soda class action settlement include anyone who purchased in the United States any beverage bearing the Blue Sky mark or brand between May 16, 2002 and June 30, 2006.

Class Members have until June 11, 2012, to file a claim to receive a cash refund equal to 50 percent of the purchase price they paid during the Class Period, up to a limit of $100 per household with Proof of Purchase, or $6 per household without Proof of Purchase.
