Bayer aspirinConsumers who participated in a class action settlement over the marketing of Bayer combination aspirin products are reporting to Top Class Actions that they received checks in the mail Friday totaling $6 to $10.

The Bayer combination aspirin settlement resolves a consolidated class action lawsuit called In re: Bayer Corp. Combination Aspirin Products Marketing & Sales Practices Litigation that alleged Bayer violated various laws in its sale and marketing of Bayer Women’s Low-Dose Aspirin Plus Calcium and Bayer Aspirin with Heart Advantage. Plaintiffs claimed that these product shouldn’t have been sold because they weren’t FDA-approved, they didn’t provide the advertised health benefits, and because they were inappropriate for long-term use. As a result of Bayer’s alleged conduct, consumers were overcharged for the combination aspirin products, the class action lawsuit asserts.

Bayer denied any wrongdoing but agreed to a $15 million class action lawsuit settlement to resolve the litigation. A federal judge granted final approval to the deal on April 11, 2013.

Class Members of the Bayer combination aspirin settlement included all U.S. consumers who purchased Bayer Aspirin with Heart Advantage between Jan. 1, 2008 and July 20, 2012 and Bayer Women’s Low-Dose Aspirin Plus Calcium between Jan. 1, 2000 and July 20, 2012.

Class Members had until April 29, 2013 to file a claim to receive between $4 and $10 from the class action settlement.

After reading these comments, I’m really suspicious. I received a check for $132.00! I think I probably did purchase these products at some time, but not enough to get a check like this. I don’t plan on cashing it because it doesn’t make sense to me. I also don’t remember ever signing up for the class action litigation.

    1. Immort says:

I never signed up either. that’s why I was afraid to cash it. But they can also get our mailing address from our credit card if we use it to purchase the product.

Here’s my story: Never heard of the Bayer Combination Class Action Litigation. Certainly never filed a claim. Probably purchased some of their 81 mg aspirin. Received the same post-card style check mentioned by others – for $18.00 – on Tuesday January 25, 2014. The check is dated January 20, 2014. Face of check says “sign reverse for redemption”. As mentioned by Ms. Hanley – there is no place for a signature indicated on the “reverse” which in fact is the address face of the “postcard”.

I have to say that this had led me to a new view of Bayer AG and the Bayer Group. This Bayer Combination Class Action Litigation is pitiful. If Bayer’s law team schemed this deal up – thinking that the way they could save much of their $15 million settlement is to mail out checks that are so stupid in appearance that they drive suspicion in the intended recipients – resulting in most of the settlement checks being thrown in the trash – you can tell them it backfired in this person’s case. I choose in the future not to spend my money with an outfit that treats its customers this way. And by the way – I can assure you that Bayer will lose more than this $18 – in lost future revenue from my family. I notice there are plenty of folks from whom we can choose to buy aspirin.

If this whole thing really is a scam – and Bayer is one of the victims – I invite someone from Bayer to tell me. If that is the case – they can have my business back.

  3. Kathy Hanley says:

There is nothing about the $12 check I received that seems legit. First I know I never signed up to participate in the class action. Second the amount of my check is more than the stated $6 to $10 settlement amounts. Third I find it very strange that by some coincidence the check is drawn on my Ohio bank which is not a national bank for a settlement by a company based listed in California. Fourth the back of the check resembles nothing like a check with proper space for endorsement, rather has a bar code along with my name and address.

It would be great if someone directly related to the case would explain all the discrepancies stated by so many people who are receiving checks for which they did not sign up for and for amounts not within the settlement amounts.

I figured it’s better to destroy a $12 check than risk my identity and bank accounts by cashing it.

Received $4 check this week. Was suspicious. After looking at Bayer’s Google product pictures displayed re the litigation, remembered purchasing one. Guess $ amount depends on size purchased.
