Capital One cashback class action lawsuit overview:

  • Who: Plaintiff Alan B. McNichols filed a class action lawsuit against Capital One Bank N.A., Capital One Shopping Holdings LLC and Capital One Financial Corp.

A new class action lawsuit accuses Capital One of failing to provide consumers with promised cashback rewards through its Capital One Offers program.

Plaintiff Alan B. McNichols’ class action lawsuit claims Capital One failed to provide the cashback rewards despite representing to consumers that they would be available within 45 days of a purchase.

“Capital One regularly failed to provide cardholders with the payout that they had been promised in the offer after the cardholders made purchases in reliance on the offer,” the Capital One class action lawsuit alleges.

McNichols wants to represent a nationwide class and Connecticut subclass of consumers who claimed a Capital One Offer but did not receive the corresponding payout.

Capital One financially motivated to breach its obligations, class action alleges

McNichols argues Capital One was financially motivated to breach its obligations under Virginia contract law and to make materially false and misleading statements with respect to the Capital One Offers program.

“Capital One was able to report higher profits by underpaying cardholders in the payouts it had promised for the use of their cash,” the Capital One class action lawsuit alleges.

McNichols claims Capital One is guilty of breach of contract and the covenant of good faith and fair dealing, breach of quasi-contract and unjust enrichment and violations of the Virginia Consumer Protection Act and Connecticut Unfair Trade Practices Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, treble and punitive damages for himself and all class members.

In early 2025, a consumer sued Capital One over alleged negligence, breach of contract and unlawful conduct that left customers unable to access their funds and deprived them of the ability to purchase essential items.

    They restricted my card when i tried to make a payment from a bank that had already been validated by them and from which I consistently made payments. When I called them the only reason they gave was “it was flagged” but could not tell me why. There would have been no reason for them to think it was fraud since I’ve been using that bank to pay my balance for years! Then they called the bank even though I told them it would be closed since it was after 5 pm. They wanted to call anyway and put me on hold for 20 minutes then came back on and said they are closed. WTH!!! Then they said the next step would be to send them my last two statements with the full account number. I said I was not comfortable with that and was basically told that’s too bad so sad for you. I told her that even if I were to send it, this bank does not put the full account number on the statement, only the last four digits. Her response was, “well just open the app on your phone and take a screenshot of it”. What??? I just said they don’t put the full account numbers on the statement, what difference does it make whether I’m on the computer or the phone?? At this point I had to end the call because I could feel my blood pressure rising!

    I called back the next day during banking hours and this rep managed to get someone on the line who told her that they would not validate my account over the phone, that I would have to go in person to one of their branches.

    I’m almost 70 and I don’t need this bullshit! Pretty soon you will have to get blood drawn to access your own bank account!!

    Yes, I’ve tried to buy 3M masks through a special 75% offer from Capital One Rewards and never got the reward.
