cadillac class action lawsuitA class action lawsuit has been filed against Cadillac Automobile Company, a division of General Motors LLC, alleging certain 2010-2013 model year Cadillac SRX vehicles were designed and manufactured with a defective sunroof design that causes outside water to leak into the passenger compartment.

Plaintiff Kelley Gaines alleges the affected vehicles have defective sunroof seals and/or sunroof drains that allow water from outside the vehicle to enter the passenger compartment, causing property damage such as wet carpet, mold, and damage to interior components.

She seeks to represent herself and a Class of all current and former owners or lessees of 2010-2013 model year Cadillac SRX vehicles in California who paid for repair and/or replacement of their vehicles because of the leaky sunroof defect.

According to the Cadillac leaky sunroof class action lawsuit, Cadillac has denied warranty coverage for issues associated with the sunroof defect, including the costs associated with cleaning the vehicles and repairing and/or replacing component parts, including wiring and electronic modules.

The Cadillac class action lawsuit notes that Cadillac issued a bulletin to technicians about the water leak, which indicated the most common potential causes as a void in the seal or a problem with the sunroof drain hoses. The alleged issue with the sunroof drain hoses is that they are too short and therefore subject to a higher level of tension that may cause them to disconnect and allow outside water to leak into the passenger compartment.

“Based on its own Service Bulletins and Customer Satisfaction programs, Defendant had actual knowledge and notice, or in the exercise of reasonable care should have known, during the warranty period covering the Class Vehicles of the existence and nature of and correction for the Leaking Sunroof defect,” the Cadillac class action lawsuit alleges.

Even though Cadillac knew or should have known about the leaky sunroof defect, Class Members had to pay to repair the damage caused by the leaking sunroofs. Gaines asserts Cadillac has failed to provide Class Members with a permanent remedy for the sunroof defect and has excluded them from the Customer Satisfaction program and warranty repairs.

According to the Cadillac class action lawsuit, Class Members have incurred and will continue to incur out-of-pocket costs and expenses to repair, replace and/or clean parts of the vehicle that have been affected by the leaking sunroof defect.

More than 222,000 Cadillac SRX vehicles are reportedly affected by the alleged leaky sunroof defect.

Gaines says her Cadillac SRX vehicle experienced the leaking sunroof defect in February 2017, when she noticed the floorboard carpet was soaking wet. She took the vehicle to be repaired, and it was allegedly determined the right front sunroof drain hose was loose. Both sunroof drain tubes were replaced, according to the Cadillac class action lawsuit.

The cost of repairing the sunroof defect and cleaning the vehicle’s carpets cost Gaines more than $1,000, the Cadillac class action lawsuit says. She filed a claim with her automobile insurance company, which paid a portion of the costs, but Gaines says she was still required to pay her insurance deductible of $250.

The Cadillac class action lawsuit asserts claims for breach of express warranty, violation of California’s Consumer Legal Remedies Act, California’s Unfair Competition Law, unjust enrichment and declaratory relief.

Gaines is represented by Robert A. Waller of Law Office of Robert A. Waller Jr. and Patricia L. Zlaket of Zlaket Law Offices APC.

The Cadillac Leaky Sunroof Class Action Lawsuit is Kelley Gaines v. Cadillac Automobile Company, et al., Case No. 3:17-cv-00989-LAB-JLB, in the U.S. District Court for the Southern District of California.

  1. Camallous Reid, Jr. says:

I am now experiencing the same problem for the second time in 14 months. First it was water throughout the floorboard of the car in which electrical damage occurred in which the car would not operate at all. This was an 1100 electrical repair.

Car is currently in the shop, liftgate will not work. Being told it is the control module that is a 600.00 plus repair and some other part that is going to cost 600.00 plus, due to a drain hose leakage in the sun roof …. this is what caused the first problem.

This and the moisture in the headlights should be under a GM Cadillac recall. I am writing GM and Cadillac on this issue. However, I feel I will probably not get a response.

    1. Peggy Cash says:

This week they finally addressed the water in the headlights, now if they would address the leaking sunroof hoses that cause the lift gate module to quit. It is a real pain to have paid top dollar for a automobile that is defiantly not worth it.

  2. Aimée Jutras says:

I am having the same problem. Water all in my 2011 Cadillac SRX and the back lift gate will not work. I am so frustrated. First the headlamp with condensation issue now this!
I have never had so many issues with one vehicle and expensive ones too.
Please tell me how I can join this lawsuit. I am so disappointed.

    1. Raymond Hillebrand says:

Problem exists for 2014 models also. I have had to replace pump and module twice in 6 months. I have only owned it for 6 months.

  3. Denise says:

I am having the same exact problem. I can hear water draining into the vehicle when I go through a car wash. This causes my trunk module to malfunction and for the 2nd time I am looking at having to have the module replaced.

  4. Kathleen Salzano says:

Same issue for me. 2021 SRX leaking on passenger side flooded car, 1st time warranty work. My service mgr told me about short drain hoses!
Next time leaked into computer components for rear door( no access unless remote works) doesn’t work if wet!!
This is 3rd time. Now I can hear the water in the car!!

  5. Christina Garcia says:

I just bought my 2010 SRX 3 days ago- not knowing about this issue until last night when a small thunderstorm came through with a little rain. This morning my drivers side headliner in the seam between the door and windshield were wet. Looks like I too, have the same issue. Feeling frustrated and disappointed as this is my first luxury vehicle and I thought Cadillac was a highly reputable company. Sad they are not taking care of their customers who had faith in their product. Please keep me updated with this lawsuit. Cadillac should take care of this problem their vehicles are creating for the owners.

  6. Nancy Renz says:

I am having the same problem for the 2nd time. FIrst on 5/2/17 they replaced the tubes on 5/9/17 I was back again as one of the tubes “slipped off” and my car flooded again. Then on 5/18/18 it flooded again and they are telling me that seeing as the last repair was over a year ago I am not covered so I have to pay again. I am not stopping until I get to the top.

    1. Rick Cortez says:

I had my 2010 in for tailgate not working.

They said the drains were clogged and it fried the electrical systym that opens the tailgate. Paid for the repair and unclogging of the drains, 8 months later, tailgate wont open, and i see dark staining on the headliner. Very frustration for a Cadillac luxury SUV.

  7. Dana Evans says:

I am having this same exact issue right now. My dealership just quoted me a price of more than $1500 to repair my rear lift gate that was damaged my leaking sunroof. How can I join this lawsuit?

  8. Martha Shopshire says:

I just paid $800 for this exact issue. I am in Indiana, will I be able to join the class action?

  9. Julie frazier says:

I purchased a SRX 2012 premium model in December 2015 fully loaded. Two days ago I had my SRX 2012 service at a dealership in Texas for hub bearing repair on the driver side. When I picked up my car I was delayed because it was being wash. When the was completed I immediately smelled mildew in my car and make the long story short…my passenger floor board was shopping wet and was told yesterday it was due to the sunroof draining hose and the dealership quoted me a price of $400.00 and recommended both be replacement. On top of both current issues, my Certified warranty expired a few days before Thanksgivings and my first issue did not appear to be major until I drove 500 miles out of town even though I had already had notice a small indication that something wasn’t right. Point is, I presented this article along with other supporting documents to my dealership this morning pretty much saying that you fix the hoses or be prepare for another lawsuit.. From what I have read, there was enough information to make this a statewide recall and GM needs to be held accountable! I hope that Ms . Kelley wins her settlement and I will keep you posted on my current situation. Thank you

  10. Kimberly Rowan says:

What do I need to do to become apart of this fiasco? My mother’s caddy leaks and the sun shade just broke because they put 10 cent clamps in to hold it up but want 1200 to fix.
