BMW Mini Cooper Engine Defect Class Action Lawsuit

2009 Mini CooperA proposed class action lawsuit says BMW of North America LLC concealed an engine defect in some of its 2007-2009 Mini Coopers that causes the cars to suddenly quit without warning.

Plaintiffs in the Mini Cooper class action lawsuit claim BMW has known about the alleged engine defect since 2008, but failed to disclose this information in an attempt to avoid the cost of repair and, instead, “unfairly shift the cost of repairs to Class Members.”

 

The class action lawsuit says vehicle owners have paid thousands of dollars in repair and replacement costs. More importantly, though, is that the alleged engine defect places drivers and their occupants at an unreasonable risk for harm. The class action details numerous complaints submitted to the National Highway Traffic Safety Administration from motorists who say they narrowly avoided accidents when their Mini Coopers suddenly quit in the middle of traffic.

Plaintiffs Joshua Skeen and Laurie Freeman say that despite knowing about the problem since at least January 2008, when BMW issued a technical service bulletin addressing the defect, the car marker still hasn’t recalled the vehicles to repair the defect or offered to reimburse Class Members to pay their repair costs.

Skeen and Freeman are seeking to represent a proposed class of all persons in the U.S. who currently or previously owned or leased a model year 2007 through 2009 Mini Cooper Hardtop or 2008-2009 Mini Cooper Clubman with an N12 or N14 engine and paid to repair or replace any engine components as a result of a defect in the timing chain tensioner.

The proposed class action lawsuit is the latest in a string of cases filed against BMW alleging a litany of alleged defects in it Mini Cooper vehicles. The German car maker has been hit with at least two class action lawsuits over allegedly defective Mini Cooper transmissions, as well as a complaint alleging 2002-2009 Minis have defective steering systems that make them “virtually uncontrollable in traffic.”

The BMW Mini Cooper Engine Defect Class Action Lawsuit case is Joshua Skeen, et al. v. BMW of North America LLC, Case No. 13-cv-01531, U.S. District Court for the District of New Jersey.

    Just had to have my 2009 Clubman’s engine replaced because it suddenly failed. I have been trying to dump this POS since a few months after I bought it. The trade in value is awful. Now I know why. It’s a money pit!

      That happened to me 2 days ago. On the highway in 3 lanes of traffic and it just died. My mechanic says i blew a piston and need a new motor. Ugggg

    Just had my mini in for a new clutch two weeks ago and drove it less than 100 miles and the timing belt broke. Nothing showed wrong with the engine. Would like to join in the suit!! I have 2009 mini.

    I just bought a used 2007 mini cooper s 2 months ago with under 40,000 miles. My check engine light came on and I started experiencing the rattling noises when cold starting. Took my mini into the dealership and soon found out that this was a loose timing chain issue due to a weak tensioner that is used on these vehicles. So i was basically told that it is my responsibility to replace the whole system with “stronger” parts. I cannot believe that bmw has not sent out a recall on this part.

    I have a 2007 Mini Cooper NonS model that died on me nearly a year ago without warning on my way home from work . I barely had time to get it off the Parkway before it lost all power. It has been an albatross. Cant afford to fix it as I owe as much as the engine replacement would cost. So wasn’t expecting such a worthless vehicle. I invested 5000.00 down on it when I bought it in 2010 and still owe 8500.00 but it’s a useless bunch of steel.
    And no help from Mini of Louisville who tried to say it was due to oil changes not performed by Mini. The mechanic who checked it out was unable to determine the exact cause.

    numerous problems with 2009 Mini cooper S….timing chain guide brook crankcase vent hose leaking oil – thermostat replaced – aux water pump replaced – water pump replaced – carbon build up at 30K and 68K

    In shop at mini Pittsburgh. Same thing timing belt . Cold start they say timing belt or tension whatever called ! Was gonna charge 2000. & now 991 .00 because I mentioned about that this issue I’ve read about & lotta mini owners not happy at all ,, should
    B recall b 4 someone gets seriously hurt or death !!

    My 2007 Mini Cooper S had the timing chain replaced at about 80k costing $2k at a 3rd party. The carbon build-up and oil burning are among many things needing to be fixed on my Mini and the transmission was replaced at 60k miles as well. Could I receive more info about this class action? Thank you.
