In January, another Mirena IUD lawsuit was filed in federal court against Bayer Healthcare Pharmaceuticals Inc., alleging a North Carolina woman was injured after using its popular intrauterine contraceptive device.
Plaintiff Angelica F. claims in her Mirena IUD lawsuit that she was implanted with the Mirena IUD in July 2013 at her local North Carolina clinic.
According to the Mirena lawsuit: “[Angelica] suffered injury and was treated for said injury in the state of North Carolina. Plaintiff suffered serious physical injury as a result of the Mirena migrating from its original position and perforating the uterus, requiring surgical removal on Jan. 20, 2012.”
Angelica claims she followed all directions for Mirena aftercare, which was provided with the intrauterine device packaging. Despite following these instructions, the IUD still failed and caused Angelica to suffer serious and life-threatening Mirena IUD side effects.
These Mirena complications include, but are not limited to, “device migration, uterine perforation, extreme lower torso pain and related sequelae requiring hospitalization, medical therapy, continuing treatment, and medical monitoring.”
Angelica has suffered and continues to suffer pain, permanent impairments, mental suffering, and a decreased enjoyment of life.
Neither Angelica nor her prescribing physician were aware of the product defects and the resulting complications associated with the Mirena IUD. Angelica has filed this Mirena IUD lawsuit, alleging that if she or her doctor had known of the risk of uterine perforation and other Mirena side effects, they would have chosen another form of birth control.
Angelica is bringing several allegations against Bayer Pharmaceuticals in this Mirena IUD lawsuit, including claims of defective manufacturing, design defect, failure to warn, negligence, breach of implied warranty, breach of express warranty, negligent misrepresentation, fraudulent misrepresentation, fraud by concealment, and punitive damages.
Angelica is seeking relief for her alleged Mirena side effects, including actual damages, treble and punitive damages, litigation expenses, payment of attorney’s fees, injunctive relief, and any other forms of relief from Bayer the court deems fit for the plaintiff.
The Mirena IUD Lawsuit is Case No. 4:15-cv-00013, in the U.S. District Court for the Eastern District of North Carolina.
Mirena IUD Problems and Side Effects
The Mirena IUD is a t-shaped plastic birth control device. The IUD is designed to be implanted in a woman’s uterus where it then releases synthetic hormones like progestin and levonorgestrel into a woman’s bloodstream.
Once these synthetic hormones enter a woman’s bloodstream, the Mirena product will “thicken cervical mucus, thin the uterine lining, inhibit sperm movement and reduce sperm survival to prevent pregnancy,” according to Bayer’s product packaging for their brand name intrauterine device.
According to news reports and court documents, there exists hundreds if not thousands of documented incidences of the Mirena IUD migrating from the original implantation site and then embedding itself in the uterine wall or even perforating the uterine lining and migrating to another part of the abdomen.
Despite these troubling reports of Mirena complications and FDA Medical Device Warnings, Bayer has continued to manufacture and sell Mirena to women who are looking for an effective, long-term form of birth control.

- Breast pain/tenderness
- Perforation
- Migration
- Ectopic/intrauterine pregnancy
- Cancer
- Adhesions
- Cysts
- Fetal injury/death

The number of Mirena IUD lawsuits awaiting trial in federal court is expected to grow as more and more women file Mirena IUD lawsuits or join Mirena IUD class action lawsuits throughout 2015.
