Bally Total Fitness Lifetime Membership Class Action Lawsuit

Bally Total FitnessBally Total Fitness has been hit with a federal class action lawsuit accusing it of depriving lifetime members of gym privileges by selling their memberships to LA Fitness, and in one case, telling a member he had to drive 5 hours to use his membership.
 
The Bally Total Fitness class action lawsuit is accusing the company of Consumer Fraud and Deceptive Business Practices for selling many of its life-time memberships and many of its clubs to LA Fitness, who is also a defendant in the case.
 
The problem, the class action lawsuit argues, it that there are geographic areas in the U.S. that do not have LA Fitness clubs, and Bally clubs that are in full operation no will no longer honor the membership contract. 
 
“For other potential plaintiffs throughout the U.S., there are no LA Fitness facilities nearby at which they can workout. For others, Bally did not assign their contract to LA Fitness, but did sell all of the Ballys in their geographic area to LA Fitness,” the class action lawsuit states.
 
The lead Plaintiff in the case, who lives in the Chicago area, was told by Bally that he can workout, but that he must do so in a St. Louis, Missouri, Bally club.
 
In other cases, the class action lawsuit continues, there is a LA Fitness facility nearby, but LA Fitness will not allow access to the club by former Bally members unless they buy a new membership.
 
The class action lawsuit is brought on behalf of all persons who own or did own a Bally lifetime membership. It is seeking compensatory damages, including statutory damages, and a Court order permanent restraining Bally and LA Fitness from not honoring Bally’s lifetime memberships.

        They told me my membership was canceled because I didnt have a location near me that was in 2008 just today litigation called me saying they are going to serve me because I never paid the account. It doesnt even show up in my credit report.

    I had a life time membership since 2002 and 24 fitness said they don’t see me in the system. I’m welcome to come down to the gym and see what options I have in setting up another membership with them. I want my lifetime membership I had with valleys homered. Who can help me.     I bought my membership in 2002 and called 24 hour fitness. They said they can’t find me in the system. How can I rectify this problem. I also had a life time membership.

      I had to sue 24 hour fitness because nobody would give me an answer to the exact question that you said once I found out that the club that they assign you to is a very first one where you bought it so you may be an LA fitness club member now versus a 24 hour fitness. So don’t think about which Bally’s you have been going to recently but which Bally’s did you originally open up a contract with. Yeah don’t expect any help from 24 hour fitness.

    I had a membership back in 2007. I had it on my bank account I later cancelled after 3 days, they told me that they did not have a copy of my cancellation after contact them, I informed them I do not owe them, they took out a judgement on me in 2008 that I knew nothing about till now and seized my vehicle which has an lien on it, I later got my car back because I owe to much on it, but they continue to harass me on paying them. They took out my initial down payment. Then now in 2018 ballys contacts me and said i owed them.2369.00. These people threatened me. That I wouldn’t ever be allowed in a gym anywhere.     I had a membership back in 97 98. I had it on my bank account. They took out 900 dollars. Everything i had. Then in 2002 or 03. I got a settlement from my job. Then ballys contacts me and said i owed them.1000.00. These people threatened me. That I wouldn’t ever be allowed in a gym anywhere. If anything can be done.
