Happy Baby Organic Class Action Lawsuit Overview: 

  • Who: A federal judge consolidated class action lawsuits lodged against Nurture, Inc, the maker of Happy Baby Organic baby food. 
  • Why: The judge consolidated 17 separate class action lawsuits against Nurture alleging the company manufactured baby food containing an unsafe amount of toxic heavy metals. 
  • Where: The class action lawsuits are pending New York federal court. 

A federal judge in New York consolidated 17 class action lawsuits filed against Nurture Inc. that allege the company manufactured its Happy Baby Organic brand of baby food with dangerous levels of toxic heavy metals. 

The consolidation will only be for personal consumer protection claims against the company, U.S. District Judge Mary Kay Vyskocil ruled on Wednesday. Personal injury claims resulting from consuming the allegedly unsafe baby foods will be consolidated in a separate class action lawsuit.

Report Claims Toxins in Happy Baby Organic, Other Major Baby Food Brands

The class action lawsuits were filed after a February report by the House of Representatives Committee on Oversight and Reform found Nurture’s baby food contained higher than safe levels of toxic heavy metals such as cadmium, lead, mercury, and arsenic. 

All of the class action lawsuits filed against Nurture cite the House Committees report, including that of lead plaintiff Nicole Stewart, according to Law360.

Baby foods produced by Gerber, Plum, Hain, Sprout Foods, and Walmart were also mentioned in the report as having “significant levels,” of the toxic heavy metals. Class action lawsuits related to the house committee’s findings have also been filed against these companies. 

Plaintiff Tyler Baker, who filed a class action lawsuit against Walmart earlier this month, claimed the company failed to warn or disclose to customers the toxic heavy metal content of its baby food.

“Based on Walmart’s product labeling and marketing materials, [they] did not expect, and no reasonable consumer would have expected, that any of Walmart’s baby food products contained Toxic Heavy Metals at unsafe levels,” Baker’s class action lawsuit states.

    My son is now 3 but my choice of baby food for him was happy baby, tho I recieved WIC happy baby was not part of the wic food list and I paid out of pocket, I preferred happy baby over gerber because it was supposed to have “better and organic” ingredients

      I have a problem with a happy babu organic food. I was used to it that i open squeezable food and give it to my baby. When he stop eating after consuming half ot it. I tried to squeezed it. I sad its black. Then i tried again and again into my plate. I feel disgusted and guilty that i gave my baby a toxic food.they say now its safe to eat when my baby have diarrhea.
