Walmart Baby Food Class Action Lawsuit Overview: 

  • Who: Tyler Baker filed a class action lawsuit against Walmart, Inc.
  • Why:  Baker alleges Walmart marketed and sold baby food with unsafe levels of toxic heavy metals without disclosing to customers.
  • Where: The class action lawsuit was filed in Arkansas federal court. 

Walmart marketed and sold baby food products containing unsafe levels of toxic heavy metals such as arsenic, lead, cadmium, and mercury, a new class action lawsuit alleges. 

Plaintiff Tyler Baker claims Walmart failed to both disclose the toxic heavy metal contents of its foods and warn customers that its baby food products were unsafe for infant consumption. 

Baker wants to represent a nationwide Class of consumers who purchased Walmart’s baby food, as well as a separate state Class for anyone who purchased the company’s baby food in Vermont or Kentucky. 

A separate class action lawsuit was filed against Walmart in April accusing the company of knowing its Parent’s Choice brand baby food it was selling contained dangerous levels of toxic heavy metals.

Baker alleges that, despite containing an unsafe level of toxic heavy metals, Walmart boasts about the safety of its baby food, going so far as to claim it has only safe ingredients, has been tested for safety, and abides by government regulations. 

Had Walmart disclosed that its baby food contained a dangerous amount of toxic heavy metals, neither he nor any “reasonable customer,” would have purchased the product, Baker said. 

“Based on Walmart’s product labeling and marketing materials, [they] did not expect, and no reasonable consumer would have expected, that any of Walmart’s baby food products contained Toxic Heavy Metals at unsafe levels,” states the class action lawsuit. 

Levels of Toxic Heavy Metals Found in Walmart’s Baby Food Can Cause Lasting Neurological Damage, the Class Action Lawsuit Argues

Exposure to toxic heavy metals can lead to cognitive, neurological, and developmental issues in children, according to the class action lawsuit, which says there is no safe level of toxic heavy metal exposure for babies.

“Many of these changes are irreversible, including permanent losses in IQ, memory, and comprehension, as well as ADHD and behavioral problems that persist into adulthood and result in reduced earning capacity,” states the class action lawsuit. 

The class action lawsuit references a February report from the House Oversight Committee, which found baby food manufacturers, including Walmart, sold baby food containing toxic heavy metals at levels above what is safe. 

Nurture Inc., Beech-Nut Nutrition Co., Hain Celestial Group Inc., Gerber, Campbell Soup Co., and Sprout Foods Inc. were also investigated by the committee

Walmart refused to show the committee its testing policies or results, according to the class action lawsuit, which said the committee indicated it was “greatly concerned,” that the company was hiding “even higher levels,” of toxic heavy metals than its competitors. 

Baker alleges Walmart violated the Vermont Consumer Protection Act and Kentucky Consumer Protection Act. He is  demanding a jury trial and requesting relief for economic losses as well as injunctive relief. 

Sprout Foods asked a federal judge last month to drop a class action lawsuit alleging the company sold baby food with dangerous levels of toxic heavy metals, arguing it was up to the US Food and Drug Administration to police the content of its products.
