Apple ID users class action lawsuit overview:

  • Who: Plaintiffs Jodi DeMonte and Mark DeMonte filed a class action lawsuit against Apple Inc. and AppleCare Service Co. Inc.
  • Why: The Apple defendants allegedly treated @me.com Apple ID users in a less favorable manner than users with newer Apple ID accounts, resulting in inferior service and product experiences.
  • Where: The Apple class action lawsuit was filed in the circuit court of Cook County, Illinois.

Apple users with older Apple IDs are allegedly subject to inferior user experiences, products and services, according to a class action lawsuit filed Feb. 23 in Illinois.

Plaintiff Jodi DeMonte says she purchased an @me.com account from Apple in the early 2000s. Since that time, she and plaintiff Mark DeMonte reportedly purchased numerous Apple products, including iPhones, MacBooks, MacBook Airs, iPads, Apple Watches, AirPods and other Apple products. 

The plaintiffs also purchased AppleCare and AppleCare+, the class action lawsuit notes.

Technical problems made Apple ID users’ products, services ‘effectively unusable,’ class action says

In early 2021, the plaintiffs say, they started experiencing significant technical issues with their Apple products and services. They notified Apple about the issues, which reportedly related to functionality, data privacy, data security and device integrity.

They have spent “hundreds of hours of their time” informing Apple about the technical issues, but Apple did not provide them with a resolution, the Apple ID users class action alleges.

The technical issues rendered Apple products and services “unfit, potentially unsafe and effectively unusable,” the plaintiffs assert.

Apple’s agents reportedly eventually disclosed that Jodi DeMonte’s status as an @me.com Apple ID user was the likely cause of the technical issues the plaintiffs experienced because Apple treats those accounts differently than Apple ID accounts created later, such as @icloud.com.

Apple also refused to pay the plaintiffs a bounty even though they met the requirements of Apple’s bounty program, the Apple class action lawsuit says. The plaintiffs claim Apple has a history of withholding bounty payments even when users should qualify.

The plaintiffs filed the class action lawsuit on behalf of themselves and other @me.com Apple ID users residing in Illinois who received services, software or operating system updates for an Apple device or product since 2000.

They claim similarly situated individuals received inferior user experiences, products and services, including a greater risk of bugs, glitches, privacy risks and data security vulnerabilities, than those provided to non-@me.com Apple ID users.

The Apple ID users class action lawsuit alleges claims for breach of contract, negligence, intentional infliction of emotional distress, fraudulent misrepresentation, negligent misrepresentation and violation of the Illinois Consumer Fraud and Deceptive Practices Act.

In other Apple news, the company agreed last year to pay $50 million to settle a class action lawsuit over allegations certain MacBook laptops had defective butterfly keyboards.

      I have experienced everyone of these problems. I started with MobileMe in 2005, and despite hours and hours of help from every Apple service known to man they have not been able to fix my cloud problems and basically continue to deny that it’s a problem I’ve gotten nowhere because I don’t think anyone has been with the service as long as I have since 2005 and I’ve tried to work around it but it’s really cost a lot of funds-
      The Apple Watch should never of said it was water resistant my sterling silver one swelled up and I have to buy a new one. It’s the same cost as it would be to repair put me on the list I own everything they have an experienced every loss I’m still waiting for my check about the butterfly keyboard, but that’s far no check in the mail.
