  • A federal judge in California removed claims from a class action lawsuit accusing Apple of knowingly selling Apple Watches with a defect that causes their screens to shatter. 
  • U.S. District Judge Haywood S. Gilliam Jr. removed warranty breach claims and a request for equitable relief but kept allegations Apple knew about the defect and had a duty to disclose it to consumers. 
  • A group of 12 consumers argue Apple knowingly sold First Generation, Series 1 through 6 and Series SE Apple Watches containing a defect that causes their screens to shatter or crack while allegedly concealing it from consumers.
  • In removing the request for equitable relief, Judge Gilliam ruled Apple already has an equitable remedy at law for the harms it allegedly committed.

Apple Watch screens were manufactured with a defect that can cause them to detach, crack and shatter, injuring wearers, a new class action lawsuit alleges. 

Plaintiffs Chris Smith, Cheryl Smith, Jason Roush, Karen Smithson and Corey Pomroy claim the watches weren’t manufactured with enough space to provide room for their internal batteries to swell, Bloomberg reports

“The detached, shattered or cracked screens are a material and unreasonably dangerous safety hazard,” the class action lawsuit states. 

Plaintiffs claim the reason for the design defect is due to Apple’s desire to have the product be as compact as possible.

The result of the Apple Watch breaking can cause injuries to wearers since the screens contain edges that are “razor sharp,” the class action lawsuit alleges.

Plaintiffs claim Apple made the watches for sale despite knowing about the defect, citing a 2015 patent which determined that battery swelling could damage the devices, Business Insider reports

Apple Has Admitted That “Under Very Rare Circumstances, A Crack My Form Along The Rounded Edge Of The Screen”

Apple previously addressed issues with its Apple Watch screens by offering free replacements to customers whose screens cracked on their Series 2 and 3 versions, Bloomberg reports.  

“Apple has determined that, under very rare circumstances, a crack may form along the rounded edge of the screen,” the company said on its website.

Plaintiffs claim Apple is in violation of multiple consumer protection laws, Bloomberg reports. 

The group of Apple Watch users wants to represent a nationwide class of consumers who have purchased the product from its first generation model in 2015 to last year’s version. 

A separate class action lawsuit was filed against Apple this month over allegations the company unlawfully seizes digital content and apps that have already been purchased in the event a payment method is declined during a new transaction.

    Hi my screen didn’t crack but I was burned badly due to my watch shocking me. I had to go to the hospital to get treated for my burn. My arm is just now healing and I have a ugly scar on my arm 😭

    I would like to be added lease. I have a series 3 and it becomes too hot to while wearing it every day. The battery is very slow and not always able to update. I’ve also had 2 other Apple Watches which are now doing try same thing.

      The judge determining apple had basically already addressed the issue is a bunch of crap, bc apple only agreed to fix screens from 2’s and 3’s. My Apple Watch 4 did the exact same thing. Screen broken around the edges and that was it, the entire thing broke. I never even hit it on anything, I barely ever wore it. This just makes me so mad. All that money wasted. I didn’t buy a new Apple Watch either. I bought a Garmin.

    My watch was completely fine till i looked down and the entire border of the screen was cracked. I didn’t hit it on anything and now I can see the battery through the edge. I wore it in the shower the next day so water got into the inside and it no longer works

    Well, I had to spend $300 to get a new watch because my watch blew out the face popped out just on the charger and the battery cause swelling to pop the front of the watch off

    My ex-husband bought me a first generation Apple Watch in 2016. It was very thoughtful as I had wanted one and he spent what little he could afford to get even an older model. After two years of wearing it everyday something very unexpected had happened. I was sitting at my desk working like I did every day, when I went to check the time and notifications, and noticed the screen didn’t respond. I found it odd as it was early in the day and i had charged it the night before. Continuing on with my work I forgot the watch was not working and slid my finger across the top of the screen as I swept my hand over to tap it once again to check and felt a pain on my finger. This was when I discovered I had cut my finger on the glass for the screen that had popped up and off the frame. I was confused because I had been sitting at my desk all morning and it had worked the day before when I put it on the charger, there was no logical reason I could find the watch I was so fond of had suddenly broken. That was until doing research to find out that this was something many other people had dealt with, many others with worse experiences than a cut finger. I continue to use Apple products, but refuse to wear the watch again because I count myself lucky the battery had a small explosion and was not big enough to damage my wrist. While I continue to use Apple products, I do also hope they are both held accountable for this dangerous defect and find a way to compensate people who have had to deal with the physical and mental stress of the experience.

    Summer of 2022 looked down my apple watch was ok, 20 minutes later looked at watch & the face was gone, & the edges had jagged glass. I was out walking. I had an apple watch 4
