If you are a California resident, you are protected by some of the strictest privacy laws in the country. When you place a call to or receive a phone call from toll-free phone numbers, debt collectors or telemarketers, you have a right to privacy, and these calls may not be recorded without your prior consent to do so.
Despite these laws, businesses have still been known to circumvent their legal responsibilities and record phone calls anyway. Some consumers have started questioning if their calls have been recorded when they have placed or received calls from a variety of businesses.
Can Companies Legally Record Phone Calls?
It is perfectly legal for companies to record phone calls, but the guidelines vary from state to state on what needs to happen prior to the business being allowed to record the call.
In some states, either party may record calls with no issues. In California, however, the California Invasion of Privacy Act, or CIPA, requires businesses to get a consumer’s consent before a phone call can be recorded.
Businesses may have a number of reasons why they may choose to record phone calls that they place or that are placed to them. Many businesses choose to record phone calls of their customer service representatives in order to train new workers. Additionally, businesses record phone calls routinely of all workers in order to ensure that they are delivering quality service.
Unlike with other forms of consent, written consent is not required. Express consent by stating “I give permission for my call to be recorded” or answering a question “Do you give permission for your phone to be recorded?” is not required.
All that is required is that the company must state that phone calls may be recorded.
Oftentimes, this comes as a prerecorded message that is played for the customer before a live agent answers the phone. Other times, customer service agents verbally state that calls may be monitored or recorded. If the customer stays on the line after being informed that the call may be recorded, that is all of the consent that is needed from the customer.
Businesses in California that do not inform customers of their intention to record phone calls via any method may be in violation of the CIPA and may be required to pay up to $5000 in damages for each occurrence of the law violation. If any actual damages occurred as a result of the business’ neglect in getting consent to record phone calls, an individual may obtain triple the amount of actual damages that were suffered.
