California companies are bound to certain regulations under California phone call recording law. They are bound to federal laws as well, but California laws are more strict.

Under California phone call recording law, companies may not record phone calls unless both parties have full knowledge of the possible recording. This may be as simple as a voice at a beginning of a sales or customer service call letting the customer know that “this call may be recorded for training purposes,” or something similar.

A company must inform a customer that the phone call may be recorded if it is recorded under California phone call recording law. If this does not take place, the company may be in violation of California phone call recording law.

AMF Bowling may be one such company.

The California Invasion of Privacy Act is a product of the California Constitution, which considers the right to privacy an inalienable right. In general, the state does not allow any recording of phone calls unless both parties are aware.

Federal law only states that one of the parties must know that the call is being recorded. Because California considers the right to privacy as so important, the laws are stricter and state that all parties must be aware.

If a customer is on a phone call and hears a recording stating that their call may be recorded, by staying on that phone call, the customer “agrees” to be recorded. This implies consent.

If a company does not inform a customer about the recording, this is considered a violation of California phone call recording law.

For example, if a customer calls into AMF Bowling and there is no indication that the call could be recorded for any purpose, and AMF Bowling does record the call, they are in violation of California phone call recording law. This is especially concerning because more and more businesses are recording their calls with their customers or potential customers.

Each offense could be subject to $5,000 in damages or three times the amount of damages suffered.

If you are a resident of California and were on the phone with AMF Bowling and did not receive a warning about call recording, there is a possibility that your phone call could have been recorded in violation of California phone call recording law.

If so, you may be entitled to legal compensation and could benefit from speaking with a lawyer regarding this.
