Abilify Lawsuit Settlement Deadline Set for Sept. 1A federal judge has ordered parties in the Abilify litigation to come up with a basic framework for an Abilify lawsuit settlement by Sept. 1.

U.S. District Judge M. Casey Rodgers is looking to satisfy some 800 pending lawsuits against defendants Bristol-Myers Squibb and Otsuka Pharmaceuticals that have been funneled to this district for efficiency in judicial processing. The pending cases are grouped together in what is called multidistrict litigation.

An Abilify lawsuit settlement was offered in three different individual cases that went to the bellwether trial phase early in 2018. Bellwether trials take a carefully selected sampling of cases and tests the arguments of both sides, giving the parties in other cases an idea of how their arguments may play out in court.

In the case of the pending deadline for the overall Abilify lawsuit settlement, if the parties fail to come up with an agreeable solution, Judge Rodgers intends to move another group of cases into bellwether status.

What Does the Abilify Lawsuit Settlement Hope to Resolve?

Abilify is a psychotropic medication approved in 2002 for on-label treatment of Tourette’s syndrome, schizophrenia, and bipolar disorder. It is also used to help alleviate symptoms of heightened irritability that are often found in patients with autism spectrum disorders. Off-label, physicians often prescribe it for conditions including but not limited to anorexia and bulimia, and anxiety disorders.

Abilify has been a huge commercial success for the defendants, but adverse event reports from patients connected the drug to an unexplained and uncharacteristic tendency to engage in compulsive gambling, shopping, and unrestrained sexual activity.

The European Medicines Agency and Canadian drug regulators moved to have the medication labeled with a warning to this effect in 2012 and 2015 respectively. In 2016, the U.S. Food and Drug Administration (FDA) finally decided to follow suit and take action, releasing its own safety warning concerning the compulsive behavior connection. According to hundreds of people that have allegedly suffered at the hands of this drug, this FDA action came much too late.

In addition to the 800 and some pending lawsuits that Judge Rodgers is seeking an Abilify lawsuit settlement for, there are countless others that are not part of multidistrict litigation. Including cases not in the multidistrict litigation, an estimated 900 to 1,600 lawsuits have been filed in state courts and federal court linking compulsiveness to Abilify.

Patients Describe Abilify Compulsive Behavior

Former Abilify patients tell tales of being driven to draw money out of emergency savings accounts and pensions to gamble with when they had not ever had the inclination prior to taking the medication.     I have been very flagrant with spending and I use Abiliify. I go through my biweekly check the same day I get it! Before I took Ability, I had a bank account I kept my funds in and bought what I needed for my apartment, first. This is unusual to me. I’m also trying to recouperate sleepless I’m going without for a few days at a time, and realize the only way I think I probably could sleep would be to skip the Abilify dose a few days or weeks, then give it a try. I’m also being very friendly, trying to help friends and neighbors out financially, when I collect Supplemental Security Income and can’t do it by default of any normal character. Is it too late to join the class action lawsuit? Let me know.     Hi my name is Brandi
    I was previously using abilify in hopes of mood stability.
    I would like to ask if it too late for help. I’m not exact on the time frames but I do know I’m very close, so I’m going to put out a rough time line for you.. thanks in advance for your time and service. I am in diar need of help from the life damages that I’m hindsight all revolve are abilify.

    All year are approximate:
    In 2007 or earlier I believe my Dr added abilify to my medications. In 2009 my divorce was finalized. On 2011 I was terminated from southwest airlines the first time after spending too many hours in the local casino and I was in able to make it to work resulting in a violation in the attendance policy. In early 2012 my union had reinstated my job to only have my job terminated for the final time In only a few short months after I had a 13 year employment history in the same city for the same company.
    That resulted in my 401k& profit sharing accounts of financial future or retirement stability being completely washed away. In less than 3 years I had literally no understanding or control of the money that was vanishing. Around $550,000 GONE. I continue my health insurance coverage by paying the cobra premiums for maybe a year and during the time up to and through 2016ish I continued to use abilify on and I praying for some stability for my home and children as well as my career goals.

    Unfortunately here I am. So desperate, so damaged, feeling like any financial situation and future are beyond repair. . devastating!
    As a las Vegas 2nd generation born and raised the gambling behavior and obsessive ways I was feeling was not normal. Gambling is everywhere here and we become jaded by the corny sounds of failure. I’m no longer taking abilify or any other medications now a days in fear of a horrible side effect and falling even deeper.. my depression is severe as I attempt to fight what should have been prevented n curious why I have to beg for compilation in hopes of reaching my goal of rebuilding myself and having retirement security..

    Please please tell me the problem isn’t really going to be a continued problem and the process will be taken care of property.
